I bought this car from Melvin Motors on 4/16/04 in Fayetteville, North Carolina. He (Mr. MelvinO sold me a Honda LX 1992 4 door white. He told me the car had been in a previous accident but it was fine now. I test drove it and it ran fine at the time. He told me that he was selling it as-is.

I told him to give me 30 days on this vehicle considering that i had to drive it back to Maryland from Fayetteville. He said no and reiterated that the car is fine it will get me home with no problems and that it should pass inspection. Why? because it will definitely pass NC inspection. Boy was that a key selling point. He showed a lot of confidence when telling me that line. That really convinced me a lot. I was still very skeptical about the whole thing though. Anyway i went ahead and signed the contract. I then started my trek back to Md in the same day.

The car broke down on me later that evening in Richmond, Va with an hydraulic clutch leak. The clutch would be pressed right to the floor and the car wouldn't move. I got a mechanic to fix it and then i began my trek back to Md. Within the next 10 minutes the car broke down again and this time wouldn't start at all. So i got a tow truck to get it back to Rockville, MD. This was a very "expensive" undertaking. The mechanic checked it out and said the engine was shot and that the car would never pass inspection there was too many things wrong with it. The car was actually running off of 3 pistons not 4 which is what was required.

The car unraveled to it's trues self in less than 24hrs of purchase. This all happened within 24 hours of purchasing the car!!! I called Mr. Melvin right away and told him what happened and he refused to do anything but ask for the rest of the money. He reiterated that i bought it "as is" and he would not dismiss any of the payments/contract that we signed.

In my opinion this company should be shut down or fined by the state of NC for doing business like this and hurting the consumer.

Is there anything else that i can do to get my $1600 back? Is it a loss cause or do i have another way of getting my money back?

But That isn't to say that he has not done wrong. In Fayetteville, Used car lots are more numerous than corner stores, and several of them are owned/operated by the same people under different corporate names. Mr Melvin has at one time FIVE lots within 1/2 mile of each other on US 301. Since Fayetteville is next door to Fort Bragg, many people take to selling cars to them with on lot financing. Mr Melvin probably had one of those forms attached to the car (as so legit new car dealers) stating whether the car is being sold 'as is' (regardless of verbal statments made about car, as it states on this form) or with warranty (the form would detail warranty) He sold the car as is, probably paid 100 bucks for it at a car auction or from a repo or abandonded vehicle tow. Any verbal statments don't matter, there is no warranty, no 30 day do overs, na da, in NC you are stuck, and yes you do owe him whatever balance you signed and contracted for, and yes Mr. Melvin takes people to court and it will show up on your credit report (I use to abstract judgments for credit report co.s),, plus he'll have it flagged on a repo list, so if he gets it back, he will sell it (again). The used car business in Fayetteville is very profitable because they make their investment back with the down payment, and can make their money over many times by reselling the car when the poor person is late by 10 days and they go pop it. Bottom line, a man's word aint worth crap unless it is backed up in writing. Sorry for your bad experience. Respectfully,

You need to check the laws of the state where the vehicle was purchased. If this was a dealership there may be a time limit regarding fixing the vehicle. Just telling you the vehicle was being sold "as is" may not get them out of at least paying half of the repairs on the vehicle.
