While I agree I was late - not once did I say that I was late by 4 months. I said that I had lost my job in December, but I made payments during that time - - just not completely up to date. At the time that they took the car - I was right at 60 days behind...not 120. And honestly - even at 120 days behind - with the amount of communication that they had back and forth as well as the fact that I WAS a consistent and on time customer prior to the losing of the job - and I was beginning work again - - they could have worked with me. I wasn't rude, non-committal, non-compliant or unable to be contacted. I was honest, upfront and always made it in there when I said I would be there. The funny thing is - - yesterday I got a letter from them in the mail asking me to refer people to them because they wanted "more customers like me" - - and this was the day after I was served with papers! Talk about absolutely ridiculous!

It's funny that you said that cars were picked up based on whether or not you had angered the person on your account. Because, all along - that is what I believe had happened. I got so angry when it was suggested that I borrow money from my family members so that my account wouldn't be past due with them. The situation that we were in was so tenuous and embarrassing and the suggestion that we just "borrow some more money" was CRAZY! I know that I replied very sarcastically and could tell that the collection person was very angry with my response. Not 2 days later - my car was picked up and no one would return my calls - not even the manager of the branch. I appreciate your input. I will look into contacting my state contacts.

While I agree that J.D. Byrider is the worst place to buy a car, I have to say that you deserved the repo. You were seriously behind, and they did wait 4 months to get the car, which is more than they usually wait from reading other posts here. So what's you beef? You think you deserve better treatment than anyone else? You were late, really late, and they got the car. At least you got your personal stuff back. Legally though, they have to prove what they sold the car for, and deduct that from the your balance owed. $8800.00 is too high, sounds like they added all sorts of fees to the payoff.

I am not surprised at this report, and I am very surprised that CNAC/JD Byrider has not been seriously looked at by the FTC. Basically, I was told while I worked there to misrepresent who I was "I'm the kids' babysitter, I really need to speak with..." and cars were not reposessed according to any set rules, but whether or not you annoyed the person in charge of your alpha. They did have the right to the property; however, they cannot just arbitrarily resell the car at their own lot. Depending on state laws (I am most familiar with Ohio and Kentucky), they have to serve you (certified mail) with right to cure (in Ohio, 21 days, Kentucky 14), then a notice of intent to dispose. They have to give you a right to attend the AUCTION where the car is sold at, within the same state that you bought it. I would contact an attorney and the your state's attorney general.
