My wife & I made an offer on a house on Jancey Street, Pittsburgh, PA that was accepted in April 2009 and subsequently signed by the seller. Ten days later, the sellers agent, Jeff Lunderstadt, sent an e-mail to our agent saying that he and the sellers had accepted a higher offer from another party. He then refused to respond to any calls or e-mails from our agent. We have now filed a lien on the property and have hired an attorney. After being served with the lien,the sellers contacted us directly. They informed us Jeff led them to believe that we were no longer interested in purchasing the house which obviously was an absolute lie. This is now an absolute mess that the seller's & our attorneys tell us could take years and thousand of dollars to resolve. Lawton Stokes (the owner of the agency) has been no better-at first being evasive, then deceptive & finally trying to intimidate us. Lunderstadt's incompetent and unethical behavior have caused great distress for us and we still have no resolution to the problem. It is inconcievable that a licensed real estate agent and his company can get away with this. There seems to be no justice at this point. Our hand money is tied up and we have no house to live in! This is crazy!!

I truly feel bad for these consumers. Their buyer's agent did not handle the situation correctly and chose to mislead these prospective buyers instead of accepting the facts and claiming responsibility for the results of the situation.

Here are the documented facts:

- The buyers indeed made an offer on the house specified through their buyer's agent

- We counter-offered back and forth until we had a "meeting of the minds", with very specific language which was to be added to the "special conditions" section of the agreement of sale, regarding five specific items (non-real property inclusions and a few conditions)

- I emailed this exact language to the buyer's agent, which my seller clients agreed to accept. The buyer's agent agreed she would use this exact language.

- The buyer's agent then re-wrote this verbiage completely, changing the entire substance of the agreement of sale of costing my seller clients thousands of dollars, had they accepted.

- In real estate parlance, this is now a counter-offer, not an accepted agreement.

When I notified the buyer's agent immediately that we did not have a deal because of these substantial changes, the buyer's agent delayed responding (over a week) and another competing offer came in. The sellers took this considerably better offer instead. A smear campaign was started against me, my broker and the agent that I worked for at the time, hoping we would give in to pressure. This report is part of that campaign. They, through counsel filed a nuisance lien on the property that was without merit. It of course was lifted.

The seller signed a release to return their hand money in a very timely fashion. Any delay in the return would be at the hands of the broker that represented them and held their hand money.
