It all started in May 1999 when we signed a contract with Jim Water Homes of Tampa Florida and several other states nationwide. Construction on the house was started in August 1999. Framing was started, through numerous fights between JWH and the subcontractor the house took from August to October to rough frame.

The county inspector came out to look at the framing and thats when the problems started. At that time the inspector RED TAGGED the house and told them to stop construction. I was informed of this not by the builder but by the plumber who was a local man. I then talked to the builder who did not know that the county had red tagged the house. A meeting was then set up with the regional sales manager that took about a week and a half to happen. At that meeting I was told by the builder that it would be a while before I would be in my home, I asked how long, he could not answer. He then said we needed to set up a meeting with the Regional Construction Mnager and the county inspector to go over alll the problems. This meeting took two weeks to schedule. Finnally at this meeing the builders managers walked around and laughed at the job the framers had done. In turn this made the inspector angry.

The problems that had happened were that both upstairs and downstairs floors were layed backwards. Floor joist were not attached roof was not braced correctly in turn pushing all second floor walls out of plum.

At this point the county inspector told them they had two choices call an engineer or tear it down. They decided to try to repair instead of tearing down. The decision on what to do then took about 30 days, we are into December at this point. Work did not start till January 2000. Rough framing was then completed end of February. The siding then started that took almost 4 weeks witht he crew finishing up at 1 in the morning and using the headlights off thier truck to finish.

We are now into late march. Interiors now start work. Home was finished if you want to call it that in July 2001. At that time several items were not finished yet they were out on a punch out list (one of those was the furnance) we also had not been given an occupancy permit tfrom the county. I refused to sign the tender agreement, but was informed they could force tender the home.

As we were living there a problem developed with the furnance and their subcontractor would not ravel to fix it. So i was told to find another HVAC man, and I did. As he did the needed repairs he noticed that this gas furnace had no combustible air present, without this carbonoxide would build up in my home, this is now august 2000.

I called the companty who in turn called the sub contractor, who told them it was there. This went back and forth for about 1 month or so, finally at the end of october I got a meeting with the builder, county inspector and my hvacman and independent inspector and the builder's subcontractor.

Finnally after a brow beating from the other the sub admitted that he knew it was not there. After that it took till the middle of november to have a new furnace installed . The story goes on punch out list problems were not being taken care, we noticed problems with our floor it was sinking, one of the walls is 3/4 inch out of plum and most of the windows are not level and most of the siding is warped.

Finnally in July 2001 I had a meeting with the builder and a promise of fixing the problems was given. It then took till September 2001 to get an agreement, and work just started in October 2001. I have a load bearing beam missing , that is why the floor sinks and at this time they can not jack the house up to get it under it. When they are able to I been told to expect cracks in walls and ceiling and much more.

This company is always rude to you , theatens to forclose on your home when you complain about them. And they will not address what they have done to you in the past.

Jim Walters and Mid-State Mortgage continue to Ripp off the Nation

It is now November 15th 2002 and the Jim Walters Saga Continues. Now their Mortgage Company (if it can be called a Mortgage Company) Mid-State have continued our problems.

In August of 2001 we noticed that our floor was sinking on the first floor, we started contacting JWH well like usual it took a month for a reply. We stated to them that the origanl Punch out list had not been taken care of along with new problems had started, we were now in the house a year.

Well, at this point we were advised to stop payments until they communicated with us. We first got a phone call of course theatening forclosure standard operating procedure for JWH. Finnally with some legal advice we were able to start communication with JWH. We stated we just wanted our house fixed. In step of course a new manager because JWH doesn't keep a REgional Manager in an area longer than 90 days.

We were told we should just let then fix things and not go to court or we may never get the house fixed. They had found out a load bearing beam was missing from the house and they would have to raise the house, this of course would cause the breaking and cracking of walls.

We agreed on a settlemnt and the work began and of course the walls all cracked and it was a mess, part of the agreement was would not make Mortgage payments until the repairs were done. Well they finished and I started making payments. In February I received a phone call from Mid Sate being their usual charming selfs stating I was behind on Payments and they were foreclosing. I told them I was not and I had the proof. They were not interested, they also said we did not have insurance and we did. They went ahead and strted forclosure first with a lawyer stating if we paid what was in due they would drop it.

I stated I had made payments and had insurance and asked for verification of debt. It was sent and I sent their lawyer back all the proof of payments. This was May of 2002. I was told by Mid-state that my account is closed and I had to deal with their lawyer. I have now senta certified letter every month with no reply from the lawyer.

They will not communicate and my lawyer says we can do nothing till they do. THIS IS A WARNING IF YOU ARE CONSIDER A JIM WALTERS HOME BE AWARE ALL THEY WANT IS YOUR HOME AND YOUR LAND. I DON'T CARE HOW GOOD IT SOUNDS AND EVEN IF IT IS THE ONLY WAY YOU CAN GET A HOUSE DON'T DO BUSINESS WITH THEM YOU WILL BE SORRY.

I JUST PRAY THE JIM WALTERS WHO DIED A FEW YEARS BACK IS LOOKING DOWN ON HIS COMPANY AND ROLLING OVER IN HIS GAVE, I DO NOT BELEIVE THIS WAS HIS VISION, AND THESE PEOPLE IN CHARGE OF HIS COMPANY SHOULD BE ASHAMED THAT THEY ARE RUINING THIS MAN'S NAME
