I purchased a vehicle from Duluth Motorsports they partnered with JM Auto Sales for the GAP ins portion. I paid off a 5 year loan in approx 25 months.

On July 29, 2009 I purchased a 2008 Dodge Avenger from the owner Brandon Agenter of Duluth Motorsports. I told Brandon I would only purchase the vehicle if I could have GAP insurance. He told me he didn't sell GAP, but would make some calls to see what he could do. He partnered with the owner of JM Auto Sales whose name is Mike for him to handle the GAP portion of the deal. The GAP insurance was $400 and the loan was for 60 months.

I ended up paying the car off on August 18, 2011, which was less than 25 months into my loan. I talked to Brandon to inform him Superior Choice Credit Union would be mailing him all the paperwork to show the vehicle was paid off early. He got with Mike after numerous attempts of Mike not returning his calls.

The GAP insurance company finally got the paperwork and sent Mike at JM Auto Sales a check on October 7, 2011 to cover his administration costs. I called the GAP insurance company after 60 days as informed if a refund wasn't yet received by the dealership. I was informed they sent a check for his administration costs and they should refund me $198.33 for my prorated refund.

Mike has refused to pay me the $198.33 owed. I have left numerous messages with his other employees as he his always unavailable. I spoke with him one time on October 27, 2011 explaining that he owed me $198.33. He didn't understand and didn't believe me.

I offered a conference call to the GAP insurance company to hear them say the amount owed is $198.33 and the check sent was for his administration costs. He refused to this call and took the 800 number ignoring my future calls.

I've had the GAP insurance company call him and they were unable to get a hold of this man who owns the dealership yet is never there. This is the third vehicle I've purchased with GAP insurance and the second where a refund was needed. The last time I received a refund with in 1-2 weeks. I believe people shouldn't sell stuff they don't know how it works.

Wow!, I am certainly amazed of how some people can really blow things out of proportion. For one, at JM Auto Sales, we have been in business for over 13 years now and have a great reputation among the community, Southern MN, Northern MN and Wisconson and even repeat customers from Canada and all over the world, even over sea's. Reason why we are in business is because we do take care of our customers and sell excellent auto's and other 3rd party Warranty's and Gap Insurance and financing on the spot. But in this situation I was informed of it after a 10-day vacation, which I rarely ever take. When I returned home I was told about the situation and I spoke with Duluth Motor Sports who sold him his new car, not JM Auto, we did not sell him his car. We at JM, just supplied DMS with the ability to sell Gap insurance on this deal as a favor, since the customer asked for Gap coverage which DMS did not provide. so I brought DMS the Gap paperwork and they sold it to him and collected the money for the Gap Insurance. I spoke to DMS about the situation at hand and I had to sign off on some of the paperwork for the refund, which I did after I received it from the Gap Insurance company. I recieved the check in the mail a 3-4 weeks later and called the gentleman that his refund had came in, and i called the getntleman about it being here and the amount of the check. He stated that it was supposed to be for more money and I had no clue why, so I called again and spoke to the Gap coverage company and they said that that was the prorated portion for the Gap coverage that they were entitled to pay out and the difference was up to the dealership that sold the Gap Coverage, which was DMS, So I spoke with the owner of DMS and told him the new updated inforamation on what was happening and the difference that he would have to pay for, since he was the one that collected the money for the Gap Coverage, JM never received a dime of this Gap coverage money. I told him how upset his customer was, because of the amount I had received back and that it did take some time to get all this figured out, it was a confusing situation, as DMS or I had never had to do a refund for Gap coverage, one because the cars we sell, there is not much reason to sell it to our customers becuase we sell our cars way under book, to where the point that Gap Coverage would just be a waste of their money, and unlike the big dealerships out there who try to sell these extra coverages just so they can make more money. I am out there to save my customers as much money as possible so they come back in the future as repeat business is key. But in this case he had asked and wanted Gap Coverage regardless as he had bought it for his past coulple of cars in the past and wanted it again. So after speaking to the Gap company again, I understood the situation and told DMS about it, the check that was made out to JM Auto Sales, so I deposited it and wrote DMS a check for the same amount to pay his customer back the money from the Gap Company and so they could pay him back also the overage amount they owed him and this way it could all be done by DMS in one check. I agree that it did take longer than I would have liked it to go, but it was a confusing situation that I the owner of JM Auto Sales was stuck in the middle of between DMS and him, since I just provided the paperwork needed for DMS to sell the Gap insurance. But as soon as I had received the check from the Gap Company, this deal was done in a timely manner, DMS wrote him his check for the full amount he was to recieve and that was the end of it. Im not out to give my dealership a bad reputaion, I work the hardest I can to take care of my customers and go above and beyond what most smaller or even big dealerships would do in most circumstances in order to keep my customers happpy and to keep returning in the future and it has worked, as we have great repeat business and awesome refferal's! And we keep a A+ Rating with the Better Business Burea, as you can see if you look us up, www.betterbusinesbureau.com  I was very sorry for this gentleman and tryed to do my best as soon as I heard about the situation at hand, we wish we could be perfect at all times but sometimes that just doesn't happen as unexpected circumstances prevail from time to time, which we try our best to fix things in a timely manner, but sometimes when dealing with a situation for a first time can take longer than expected and we apoligize for that, but once all the correct info was understood, we worked our best to get it taken care of right away, which we did after all was understood. So I apoigize for any inconveinance at JM Auto Sales, but we were pretty much were just stuck in the middle of you and DMS, trying to help out. Im glad to see the money owed was paid in full, I was just trying to help out another dealer so he could keep you happy by providing a service that they didn't offer. And I won't do it again as JM just got slammed in the complaint you wrote and we were only trying to help.
