I have never in my experience ever dealt with a company as unethical and desperate as Kayak East Coast, Inc. I should have known when I could not come to their office to sit down and go over the pool. However, I liked the pool so I kept the faith. Thereafter, they allowed three days to cancel a contract but when you attempt to call them on the phone or get information during that three days, they never call you back. One week after I entered my contract, Kayak mailed me the information I needed in order to apply for my permits which I received 10 days later, that's when I found out that my pool was going to cost me an additional $3,000.00+ to be installed. Further, when I stated that in the State of New Jersey final payment of $17k doesn't have to be paid by law until all inspections are complete, I was told that my original contract was amended and final payment was $250.00, conveniently an amendment mailed to me that morning. I have no problem paying the additional costs if I was told about the costs from the outset. However, Kayak deliberately withheld the costs and then refused to cancel my contract and amended the contract without my consent (which is unlawful). Further, Kayak was not confident enough in its installation and product to wait for final payment after all inspections were complete. In all my experience in the legal field, I have never run into a company that is so desperate for business that it would rather incur $20,000 in legal costs then simply cancel a $17,000 contract. Res Ipsa Loquitor....let the buyer beware....I personally will not deal with this company again.

For any person whom is no knowledge of the law. Do not let this company bully you into not holding up their end of their contract simply over one or two disputes in the purchase order. This is how they show lack of compliance on your end to a judge in case of a lawsuit. Always carry out your end of the contract. Obtain financing, agree to pay, get permits, buy your sand, etc. Do everything needed to get your pool delivered and installed. Let the company fail to uphold their end of the contract. They will inevitably shoot themselves in the foot. Also, if you wait to close on a home equity loan until the day after installation, you will simply be charged $500.00 by Kayak. I'd rather pay $500.00 then pay $17k for a pool that never gets delivered or installed. Do not let this company bully you by saying they will get their attorneys. Again any company desperate enough to pay attorneys $20K to enforce a $17K contract is just that....desperate and not reputable.

you sound as if you spend most of your days thinking how to rip businesses off! You probably furnished your whole house that way! Now it looks like you tried to start in your yard?? I know of this company and in fact have done business with them. I had no problem with them in fact I had to give $$ up front on delivery and just as you stated!! No big deal. The pool was installed and I paid the balance when the inspector came out. They even waited 2 mos for the $$ that's how long the inspection took to get. It's people like you that make businesses make up rules to make sure they get paid for there services. you need to get a life and wake up. It's people like you who ruin it for us consumers that have the $$ to pay.

It's not my fault you wrote your own purchase order in terms that you don't like. You expect your customers to be held in strict compliance on the purchase order but you don't want to do so. With all my legal experience, I do know that if you write a contract and the parties agree to it, you cannot unilaterally change it because later you find out that it doesn't work in your favor. Also, Mike, could you please ask your employees to stop calling me from their personal telephone in an effort to harass me on the weekends.

I think when a consumer gives info to these sites the info should be correct!! Obviously M from Blackwood ( not even where she lives) doesn't feel the need for the the truth!!! First off M we were trying to obtain financing for you as a service thru a 3rd party lender!! For reasons out of our control we were unable to do so.Our contract with you is not contingent on financing. All contracts that are financed thru one of our 3rd party lenders usually do not require down payments but we are guaranteed our $$ on completion and final inspections. In your case you claimed you could get your own $$ we consider that a cash transaction. Cash transactions require minimum of a 1/3 down on signing of the contract. Everything but $2,000 on delivery!The balance of $2000.00 $1750 would be due on completion of installation $250.00 would be held until final inspection is completed. ( in NJ only) The other facts you state are simply false. We talked to you several times while trying to obtain financing for you! you even faxed additional info to us!!!! this during your 3 day right to cancel!! YOU PUT DOWN $631.00 ON A $17,000 pool and you think we should deliver this pool ( pool is delivered by a semi tractor trailer) install it and then wait for our $$ until final inspection!!! all for $631.00 You could probably go shopping from here to the moon and never find a company willing to do that!!! You state we withheld costs????$3000.00 it states on our contract you are responsible for sand, water, electrical, and a permit. I'm sure you read your contract before you signed it with all your legal background!!! We do a lot of business in NJ and are well aware of the laws. I'm sure these laws were not put into effect to allow consumers to try to RIP OFF Contractors IT IS A SHAME THERE ARE NO SITES LIKE THESE THAT ALLOW COMPANY'S TO COMPLAIN HOW CONSUMERS TRY TO GET OVER ON THEM
