Case law has changed the way withholds are to be treated. The Florida Supreme Court has held that a guilty plea or verdict with a withhold of adjudication constitutes a conviction.

In addition, the sealing and expunction statutes also preclude the removal from the public record of a number of offenses regardless of the withholding of adjudication. The most notable offenses are those that involve acts of domestic violence. F.S. 775.08435,7 which precludes courts from applying withholds for the defendants need and amenability for specialized treatment for a mental disorder, the need for the payment of restitution.

 F.S. 322.34 indicates that the legislature intended the term conviction to mean a determination of a defendants guilt by way of plea or verdict. Therefore, the court concluded that it is clear that the Florida Legislature intended that a conviction, for purposes of F.S. 322.34(1), is to include both adjudications and withholds.

My name is Tom Wolf and I live in Oviedo, Florida. I am the man responsible for posting this review about Kerry McDonald as well as one other review about him on this web site. One uses his real address and the other a variation of the numbers in his address.

I posted both of the reviews because I was very angry and blamed him for the problems in my life that I have created. I blamed him for a web site about me that showcases my past issues with the law and with others. I had gone to great lengths to hide my past and I blamed him for the fact that it was still being exposed for the world to see. I choose this web site because they don't verify the truthfulness of anything posted on here and because once posted they won't remove anything without the person paying thousands even if it is a complete and total lie. You can anonymously post anything about anyone with complete immunity.

Both of the reviews that I posted on this web site are lies - crap that I made up to embarrass and humiliate him. The names of the people are made up as well as the reviews themselves. I've since tried to get this web site to remove the posts and explained what I did but they would not unless I pay them $2000 and I simply don't have that kind of money so I am writing this to try and correct the wrong I have done.

During the past few years I have said and done disgusting, vile and terrible things to Kerry McDonald and his wife because I wanted to strike backat him because I held him totally responsible for keeping me and some of the things I now regret doing in the public spotlight. I now know that was wrong. I admit that I threatened him initially which started our hostile relationship. I then escalated everything when he didn't back down like everyone else always did. I wasn't used to people standing up to me. That guy was like a friggen honey badger. I now realize that had I not threatened to harm him or his wife that the web site about me would have never gone up initially and we could have both just gone on with our lives. That was a mistake I have
lived to regret. I should have backed down and apologized but I never backed down from a fight before or admitted that I was wrong. I tend to react quickly without thinking of the consequences when I feel that I am provoked or disrespected in any way and everything just escalates from there but with the help of my current therapist I hope to resolve that issue in my life and learn how to control my anger issues.

I am trying to turn my life around and put my past behind me. I have made a lot of mistakes and hurt a lot of people in my life. I am currently working with a therapist and she told me that I had to at least attempt to try and make things right with people that I have attacked or hurt in my past to show that I am sincere. Maybe they will accept my apology and maybe they won't but I had to try she said because it is part of the process. I know that I have an issue with taking responsibility for my mistakes and I am working on that. I know that I have an issue with substance abuse and I am working on that also. I will no longer deny, lie about or make excuses for what I have done to others in the past. I am so tired of trying to keep my stories straight. I just want a normal life.

I can't change what I have done in my past and I can't undo the damage that I have done to peoples lives but I am now trying to take responsibility for my acts and show that I can be a decent person and move forward from here.

In the past at times I've acted like a person completely out of control and said things and done things that I know not to be true and which are despicable. I am now deeply ashamed of everything I said and did and I apologize to Kerry McDonald, his wife and his family and all the others that I have attacked in my life.

I am tired of living a lie. I am tired of lying and trying to justify and making up excuses for my past. I am so tired of worrying about someone finding out about some of the inexcusable things that I have done in my past and then having to make up an elaborate story to try and explain it away or just deny it outright. It is what it is. I'm getting to old for games anymore. I just want peace.

I want to be able to move on from here and not be judged by all of the horrible things that I have done in my past. My hope is that by admitting my past mistakes and taking responsibility for them that people will look at me in a different way and give me a new chance. I also hope that the people hosting the web site about me will see that I am trying to acknowledge my mistakes and make things right and become a changed person and then maybe they will pull down the site.  I also plan on writing the Judge and seeing about getting my name change unsealed so that there is complete transparency in my life. No secrets or tricks.

I have said and done things to many different people that were cowardly and cruel especially to the women in my life and for that I am sorry.  There is no excuse ever for hitting a woman and hopefully I never will ever again. My new mantra is no secrets and accepting responsibility for everything that I have done. The good the bad and the ugly.

When I first read this, I had to laugh because it was so off the wall. This is part of an ongoing campaign by a man who now goes by the name of Tom W. Wolf of Oviedo, Florida, to try and somehow discredit me and smear my name because I had the audacity to stand up to him back in early 2010 when he threatened to harm both myself and my wife and
I then exposed his twisted and psychotic personality on the internet.

I have long ago moved on with my life but he continues to harass me because others that he has attacked and abused have continued the cause and he blames me for starting it all. By the way, this is not the first thing Tom has posted about me on this site. Look up my name and you will find another bogus post with my address numbers all mixed up. That one also involves drugs and sex and it sounds like it was written by a 10 year old. Tom has a fixation with those 2
subjects. Seriously.........I guess an at home work job or at home training was the best he could come up with because he knows my background is squeaky clean and every one that knows me knows that. Unlike him, I don't have to change my name to hide my criminal past. His real name is Thomas (Tom) Walter Tempfer of Oviedo, Florida and he changed his name according to court documents in April of 2011 and then apparently got a Judge to seal the name change so that his new name wouldn't be connected to his seriously psychotic and violent criminal past. Fortunately, someone was able to find that out and connect the two names. Tom is so stupid! He used key words in this complaint like store husband and computer geek and Chuck Connors that only he would know and not a stranger and then he signs the complaint with my former wife's name. What a idiot!

Tom W Wolf aka Tom Tempfer is such a mental midget that in early April of 2011, he came by my wifes work place, pretending to be someone else and dropped of a letter detailing all of these threats that he was going to do.
He didn't realize that he was recorded on security video, the receptionist picked him out from his many current mug shots even though he was clean shaven at the time and the best part of all was when Gloria Harbaugh from the Seminole County Sheriff's office provided a copy of his travels that showed him entering the complex at precisely 9:10 a.m. To deliver his manifesto. You see, the genius forgot that he was wearing a GPS monitor at the time. The monitor was on from his second arrest for battering a woman. That is all a public record for you to see on the Seminole County Clerk of Court web site under his old name of Tom Tempfer. Check his on line mug shots and you will also see that Tom Wolf and Tom Tempfer are one and the same.

While the Orlando Police said that he couldn't be arrested for just dropping off the threats, they did say that if any of them came to fruition then he will be the guy they go after because he already spelled out what he was going to do. The one Orlando Police detective said that he should probably be on that show America's dumbest criminals because he is such a moron. Giving someone a blueprint of crimes you are about to commit? Really??

This man has some serious issues. Please feel free to check me out as I have nothing to hide. I can only assume that this sociopath will continue to harass me and to publish trash and made up lies like the above forever or until he end up in prison where he belongs. I have had nothing to do with running any web sites regarding Tom W. Tempfer or Tom W. Wolf since April of 2010. He has pissed off and hurt a lot of people in his past and now apparently people have had enough and are no longer afraid of him. He has always gotten his way by manipulation, threats and physical violence. As I said earlier, check out his background and mine and let the truth speak to you. As a true sociopath, Tom attacks others with lies to try and deflect the truth from himself. It's what they do.

I am not going to stoop to Tom's level and publish anything about him on this web site (which charges you thousands to get it removed) because I refuse to play his game although that would be easy because his past is filled with lies, fraud and violence which anyone could verify in a New York minute. Everyone that knows me knows I am a good and decent person and everyone that finds out the truth about him knows that he is a pathological, toxic and evil person and I am just going to leave it at that. Let the facts speak for themselves. I am not going to waste any of my life reacting or responding to him beyond this point. He is who he is, a pathetic and sick man.
