I have had this attorney after me for a few years now. I challenge his every move and he is frustrated. He delivered the summons to me to another address. Needless to say, I missed the court date and got a judgment against me. To make a long story short, I have been trying to get this guy to validate the debt. He refuses and therefore I deny owing the debt. I filed a motion with the local court to have a judgment vacated and sent a copy of this to the collection attorney. He wrote me back with a copy of a letter to the judge sent to me as well. Needless to say he isn't very happy.

The latest barrage from me is I filed a small claims against this guy. I claimed 3 violations of FDCPA and 1 violation of FCRA. Four different small claims actions at 75 hundred per violation. When the Constable delivers the summons this guy is going to have a heart attack. Fireworks are on the way!

Don't let some faceless attorney push you around. Make them prove everything every step of the way. As someone mentioned, they might go away and find an easier target who will just roll over and take it.

Dear Micheal of West Jordan:

I had a similar negative experience with Kirk Cullimore and Associates but not the extent you have experienced. There is a similar case that I found on www.businessreporter.net with the same attorney. I found a similar pattern in that the company seems to send documents to a wrong address intentionally so that the "accused" has no chance to appear in court. Therefore, the judge will default on the "accused" and favor Cullimore's client. The name of the complainant is Mike and he too will lodge a complaint at the Utah State Bar and the Attorney General's Office. You may want to check out his experience with this law firm which he says is Money Hungry.

My personal experience with this company is more on a weirder side. My first encounter with this law firm was on 8/23/2010, when I had to pay a fee for client they represented. The lady's name was Tanny who was not really nice. I think they train the people who answer the phones not to be nice for intimidation. Anyway, I found it very odd b/c I told her that my attorney told me that my debt has been paid and that there is NO debt when the HOA fee already has been paid. My attorney advised me that this attorney's fee should be waived. Tanny said NO and she is very well trained to intimidate. I reported this to my attorney which he found very strange. Long story short I paid and gave her my card information. But when I asked for a receipt, she said that they do not issue receipts. This is strange. All companies issue receipts for any transactions. Are they hiding something? Maybe revenues from the IRS? Anyway, it was really strange since she said my receipt is what is on my bank statement.

This is supposed to be a "professional" law firm and sends out tons and tons of collection notices and letters. But won't issue a receipt? They amass a lot of wealth but scrimp on 44 cents for a stamp to give proper and due notice and acknowledgment of a transaction. Very, very odd for a law firm amassing millions and millions of fees since 1984.

As usual with someone who is sued for a bad debt, this is just sour grapes. At no time did he ever file a small claims action against me or my firm. Since I cannot identify him by what he posted, I cannot fully rebut his claims. However, we are a legitimate lawfirm that has been in the business of bad debt collections since 1984. We have never paid out a claim on an FDCPA or FCRA violation. If you want the truth on litigation matters, check with the courts.
