Hello, my name is Nicholas and I was a member at a albany,ny LA Boxing gym. I started my one year membership at june/july of 2009 up until june/july of 2010. The issue I'm having with this gym is that they are still charging me even after months of  1 year membership is up. I checked my bank balance and I noticed the charges. I then contacted the manager of the LA Boxing and told him the situation, he then proceeded to tell me that I signed up for a renewal when I never did anything such. The reason why I know this is I did not go to the gym the last two months of my contract because I suffered a knee injury dealing with a tear of my petaller tendon. He told me that he will call me back in 10 minutes. He never called back. I went to my bank and cancelled my card that they have on file at the gym. I'm still concerned about getting my mony back. Please I'm unemployed and have a three year old daughter I need help to get that mony back. Please any type of legal consultant will help.

Thank You for listening,

Nicholas

Nicholas,

When you signed the one year contract if you read the contract you do not just stop being billed at the end. When you sign a one year contract you do so for a lower price in return for being a member for 1 year, however in the contract it clearly states that after your one year is up you then move onto a month to month billing cycle unless otherwise cancelled or a new contract has been signed. It's just like any thing with a "free trial period" such as credit reports - it's free for 30 days but if you don't cancel it goes on to month to month billing.

What I suggest is going to the gym and talking in person. I don't think you will be able to get your money back since it is in the contract, but going in there and talking to them face to face in a calm, collective manner couldn't hurt.

I am not affiliated with LA Boxing on an employment/corporate level, however I am a member who has read and signed a contract with them (and many other companies before) and am very familiar with contracts being a small business owner myself.

Good Luck.
