The BBB contacted LA Fitness on my behalf and LA Fitness has agreed to refund me.

I get that you are upset with the employee for not following thru with the cancelation per your request. Its still up to you though to get it in writing when they do cancel. So In a sense they do need to reverse your charges once you provide them with the cancelation form that was completed when you returned your membership card. Again, I have not cancelled anything that was contracted without getting it in writing. Perhaps that is the issue. Written proof more often wins when contracted obligations are terminated. Not sure this legally falls in the fraud category. You may want to check with a lawyer on that based on your states definition.

Obviously you did not read the report carefully enough.. That is not the issue. When I entered an asked for a refund, the saleman assured me that the transaction was refunded and took back my ID card which allowed me entry into the facility.. The saleman mislead me into believing the refund occured.. This is border line fraud.. It is not my fault that the salesman did not perform his job correctly and failed to process the refund as he said.. And if the terms of the agreement prevented such a refund then this should have been explained to me.. Think if this werent the technological age and thigs weren't done through computers this error wouldnt have occured.. The fact that the employee was fired and that he didnt hit the right buttons is working against me here.. By requesting a refund and receiving verbal confirmation that a refund occured from the charging party I deauthorized all charges. Therefore all the charges I received were unathorized.

Really??? You sign up willingly, give your credit info and more then likely agreed to a YEAR membership. So Go check out your "CONTRACT" and process for terminating. 99% of consumers like to live in the mythical world that because they didnt use the service they should be fully refunded!! Well as politely as I can say...you are WRONG! I don't use my ambulance membership yet each year I sign up for it just in case. Each year I get auto insurance yet I do not make claims on it. So guess what??? You just don't get a free ride and then pull the rug out. Follow the "WRITTEN" procedure for cancellation. You may have to pay a penalty for early cancellation fee, but at least just like how you ridden yourself of a gal, you can rid yourself of this financial obligation. And do it in writing. certified mail....it cheaper then the 275$ that is compounding.
