I had hired Mr. Kim McLane for handle my divorce case back in July 2001. I had paid him $2500.00 for the case and he had told me the divorce will be final. Since then we have been to many court appearances but nothing has been solved except I have wasted large amount of money for delay and lost 2 vehicles from so called soon to be ex spouse. I had called Mr. McLane many time about the status of my case but I kept getting voice mail messages that he was out of office or on vacation. The judge even asked why was this case taken so long.

I had finally fire Mr. McLane and acquire a new attorney. Within 2 weeks, I have the custody of my 3 children and don't have to pay child support. The mother now must pay me. My children are alot happier to live with me and their school grades have significantly improved 95%. My divorce is almost final. I want my refund from Mr. McLane or at least 2/3 of the fees I had given him for non service to his part. What is my option? I would like to file a complaint with the state bar association but I need some advice from anyone first.

I was in a car accident about 5 years ago. You only have 2 years to file for damages but I hired an attorney immediately. A week before the 2 year deadline, I fired the attorney and promptly got another...who had to scramble to get the case filed. I immediately filed a complaint with the bar association in my state. Formal charges were filed against him. Because of this, I didn't have to pay him a dime for the 2 years of non-work he did. Give it a try

The rules that govern lawyers require that fees be reasonable. Contact the state bar and ask about a fee arbitration service. Better yet, contact a local attorney who handles professional malpractice cases for some advice if possible. Nobody here can legally or ethically give you any more advice than that. Best of luck!
