I secured the services of Christopher Yeazell, an attorney w/ the Law Offices of Kevin A Moore in Dec. 2005 as my divorce attorney. After the initial consultation, I felt very much in the dark about what was going on and that Mr. Yeazell was not expediting the situation. My primary relationship with him was leaving messages on his voice mail.

I found out that Mr. Yeazell had been devoting virtually all his energies to a murder trial. He assured me that his law offices would not take on cases they could not devote appropriate energies to. A requisition for all my records ane expenses came from the opposing attorney. This was forwarded to me exactly as received without any explanation or guidance as to what I should do.

Upon meeting w/ Mr. Yeazell in person in April 2006, I found he was preparing for yet another murder trial. I decided to find another attorney who only specialized in family law instead of as a sideline. Upon interviewing attorneys in the area, I asked their opinions on the "non-refundable" retainer w/ Mr. Yeazell. They all felt that despite the language, any honorable attorney would return the balance and that it should not be a windfall for doing nothing.

I received a voice mail from Mr. Yeazell asking for verification of the change of attorney and that he wanted to "discuss" my retainer and my reasons for changing attorneys. I then called back multiple times, each time getting his voicemail. I finally articulated my reasons for changing attorneys to his voicemail. He never called back.

I finally sent a letter in August 2006 asking for the balance of my fees retainer and an accounting of the costs retainer. I received a letter back from Mr. Yeazell stating that since it was a non-refundable retainer, he was pocketing the money, nearly $3000. There also was no accounting for the costs retainer. A check for the costs retainer arrived w/o accounting late December 2006.

I entered a complaint with the Hillsborough County Consumer Affairs and was told that the bar association "policed their own" and that the county and the state had no authority to do anything!!! The bar association wasn't interested.

So the moral of this story to avoid being ripped off yourself is don't hire Christopher Yeazell or anyone else in the Law Offices of Kevin A Moore and don't sign a 'non-refundable' retainer agreement w/ any attorney.

And to be very clear, the retainer balance in question turned out to be far less than $3000, more like 10% of this figure. For whatever reason, I had not received all invoicing and the firm moved quickly to provide complete documentation.

I had a pleasant conversation with Helen Moore of the firm. This situation appears to be very much not the norm there and they want to do everything possible to resolve this issue and make things right. They have promised to refund the outstanding balance of the retainer and provide all documentation of expenditures and invoicing. After speaking w/ Helen I feel much better about the situation and recommend any clients or potential clients to contact her to resolve any concerns you might have as things progress. In any human endeavor, misunderstandings develop and if someone's services are in demand it must be because they're worthwhile.

Larry you are exactly right. A "bar association" is like a club - it's a group of lawyers in the same geographic area or who practice the same type of law. What you need is the State Bar. Usually (if not always) the state bar is an arm of your state's highest court, which is referred to as the supreme court in most states.

I am not familiar with Florida, but it may be set up like Arizona. In Arizona there is an agency of the Judical branch of state government called "The State Bar of Arizona." This can easily be confused with lawyer groups like the Arizona Bar Association. They are not the same. The State Bar is the organization that regulates lawyers. It determines who may practice law and who should be disbarred or suspended. If you have a dispute with a lawyer in Arizona you would file your complaint with the State Bar and not the Bar Association. My suggestion is that you do some research to see whether there is a state agency that regulates lawyers in Florida and make a complaint to them. BTW, Arizona courts have ruled that a lawyer is entitled to keep only that part of a retainer that he has earned. You have a valid complaint but it sounds like you were sent to the wrong agency.
