And to be very clear, the retainer balance in question turned out to be far less than $3000, more like 10% of this figure. For whatever reason, I had not received all invoicing and the firm moved quickly to provide complete documentation.

I had a pleasant conversation with Helen Moore of the firm. This situation appears to be very much not the norm there and they want to do everything possible to resolve this issue and make things right. They have promised to refund the outstanding balance of the retainer and provide all documentation of expenditures and invoicing. After speaking w/ Helen I feel much better about the situation and recommend any clients or potential clients to contact her to resolve any concerns you might have as things progress. In any human endeavor, misunderstandings develop and if someone's services are in demand it must be because they're worthwhile.

Larry you are exactly right. A "bar association" is like a club - it's a group of lawyers in the same geographic area or who practice the same type of law. What you need is the State Bar. Usually (if not always) the state bar is an arm of your state's highest court, which is referred to as the supreme court in most states.

I am not familiar with Florida, but it may be set up like Arizona. In Arizona there is an agency of the Judical branch of state government called "The State Bar of Arizona." This can easily be confused with lawyer groups like the Arizona Bar Association. They are not the same. The State Bar is the organization that regulates lawyers. It determines who may practice law and who should be disbarred or suspended. If you have a dispute with a lawyer in Arizona you would file your complaint with the State Bar and not the Bar Association. My suggestion is that you do some research to see whether there is a state agency that regulates lawyers in Florida and make a complaint to them. BTW, Arizona courts have ruled that a lawyer is entitled to keep only that part of a retainer that he has earned. You have a valid complaint but it sounds like you were sent to the wrong agency.
