In 1997 I lost a job of 11 years due to down sizing. In order to keep from losing our home, my husband and I filed Chapter 13. During the time we were in wage earner, our mortgage company sold our loan to Litton Loan Service out of Houston, Texas.

After 3 years, we were able to have our wage earner discharged. We were told by the Chapter 13 trustee that our mortgage was current, and they would contact the mortgage company about the discharge.

We began paying our mortage payment as usual, but within 2 months, we got a letter from Litton stating we were 6 months behind and they were going to start foreclosure unless I paid them $3000.00 and paid 1 1/2 times our mortgage payment each month until we were caught up.

We paid the $3000.00, and began making the payments so we wouldn't lose our home. A few months after we began making the payments, our granddaughter, age 8 months, had to have open heart surgery, and was in the hospital 3 months on life support. I lost time from work, and missed a payment.

Once again they threatened foreclosure, and once again I had to come up with another $2000.00, and start out 1 1/2 payments all over again. What we had already paid wasn't enough I guess.

We did this until the mortgage was paid up current, which was 5 months ago. We are now trying to refinance our home and get out from under Litton, but they are still reporting to the credit bureaus that we are in foreclosure, and that we were behind multiple times over the past year, even though we paid the note every month, without fail. They are saying that they report according to the contractual date, whatever that means.

We want to refinance and get away from them, plus get a better interest rate, but because of their underhanded reporting tactics, no one will work with us. We feel that they just don't want to turn our account loose. Also, after doing some research, I found out that when we were discharged from Chapter 13, Litton added back all the late fees and other fees that they couldn't add when we were under wage earner.

Hi Kathyrn sorry it took me so long to respond, been busy researching my original lender, Superior Bank, FSB that was closed by the FDIC. That is a horse of another color. Hello again Diane. I caused you to misunderstand my first rebuttal. We paid the forebearance plan in full bringing our mortage loan current. We did not pay the entire loan in full. We still owe 23 years on that. I will send a statement to Kweku Hanson, and hope that we can get something done. I am fixing to have major surgery in December, and we are scared to death that Litton might try something then. By the way, our original mortgage holder was Equivantage which was obtained through Volunteer Financial Services. They transfered the loan to some company called AIC (or something like that), who then turned around 2 months later and transfered our loan to Litton. All of this was done while we were under Chapter 13. Would you happen to have the law firms names that are or have file any law suits against Litton?

Hello again Kathryn great to hear from you. Now I understand what has happened. " We were at their mercy. I did not want to lose my home, so that is when we went into the forbearance plan with them. We paid religiously every month until it was paid in full, which was paid 2 months early, but they still have our credit report looking horrible. Thank you for any help you can give." You definitely need to do that RESPA letter, especially for Litton Loan even though your loan is paid in full. Have you received a discharge from Litton and has it been filed properly at the clerk's offices either county or municipal? Next contact all the credit reporting agencies and if you have the discharge provide them with a copy so they can amend your credit history. This is something Litton Loan should have done, if they were a reputable servicer. For some reason Litton and the others seem to get pleasure making us squirm even after they have stolen more money than needed. At least in your case Litton does not have your home. You are one of the lucky ones, but all those fees and legal charges they made you pay in addition to the stress, humiliation should be justified and compensated. Please send a notarized statement regarding what Litton has done to you there is still time to get involved in making Litton pay for their crimes. Send that statement/affadavit to: Kweku Hanson, 487 Main Street, #2, Hartford, Connecticut 06103 Telephone: 860-728-5454, Fax: 860-548-9660. Also do some searching join a yahoo group they offer much support. Definitely get involved with any of the class actions there may be a rainbow waiting for you and me when those cases are won. Hello Diane from Buffalo, New York. Thank you for you information. In answer to some of your questions, our loan was sold to Litton before the Chapter 13 was discharged. We did not complete the pay off period on the Chapter 13. We voluntarily came out of it because our income had improved. We contacted the BK trustee ourselves and were told that our mortagage loan was current. When we recieved the notice that we were 6 months behind, I called Litton and had them do a research on the account, which took almost 90 days, and they still stated we were behind. Our attorney was not helpful at all, so we fired him, and just tried to take care of it ourselves. We contacted the trustee back, and again she told us that we were current with our mortgage. We were at their mercy. I did not want to lose my home, so that is when we went into the forebearance plan with them. We paid religiously every month until it was paid in full, which was paid 2 months early, but they still have our credit report looking horrible. Thank you for any help you can give.

Litton Loan does it again home in foreclosure to credit bureaus when mortgage is current

Hi Kathryn from Williston, Tennessee noticed your post and am very interested in 2 of the points you raised that need addressing to help you fight Litton Loan Servicing a division of C-Bass with corporate offices in New York. You had filed Chapter 13 in order to save your home, at the end of the payoff period your account was transferred to Litton Loan by the previous lender who had been notified that your account was current by the BK trustee. This confirmation should have been included in the account status at transfer with the discharge papers. Your comment, " We began paying our mortgage payment as usual, but within 2 months, we got a letter from Litton stating we were 6 months behind and they were going to start foreclosure unless I paid them $3000.00 and paid 1 1/2 times our mortgage payment each month until we were caught up." Kathryn this is where it becomes confusing when you received the Litton notice did you contact Litton and request an explanation? How could you be 6 months behind if the transfer occurred at the discharge? Did you refer this back to your attorney and the BK trustee? What Litton has attempted to do is manipulate your account and your other comment about adding all those additional costs ( late fees & legal fees) that they added back in because they were not permitted brings up another issue. This statement does not make sense, but it does depend on the exact date of transfer, which you need to confirm. You need to know the exact date, it appears Litton had your account prior to the discharge. You need to get your attorney and the BK trustee to look into this. Secondly who was your prior lender? The reason I ask this is that this is part of the conspiracy that goes on. Too many others have suffered these indignities and fraud at the hands of Litton and others. " We feel that they just don't want to turn our account loose." This is so true your home may have equity and this is another game these servicers like Litton play. If you have read some of the prior complaints from this site you should be aware that there are 2 class action complaints filed against Litton Loan already, one in Tennessee and the other in Connecticut. Protect yourself and contact these law firms, just do a search on Litton Loan and you will find much support and advice on how to proceed at the other web sites. Join in and speak your mind. Next you must write 2 RESPA ( Real Estate Settlement Procedures Act), letters to both the original lender and Litton. Check out the FDIC web site, both lenders and servicers are required to comply with this request. There are also samples to help guide you. Then start making a file and copies of all payments, etc.document everything that has been sent to you by Litton or one of ambulance chasing attorneys, and their calls noting times made. Be prepared they will call you non stop and at inconvenient times. Litton is well known for harassing phone calls, besides being rude and nasty when you try to contact them if you can get through. PS. There is a program with the NCRC and information on this has been posted at this site for other thieving servicer/lenders Centex, Ocwen, Fairbanks, etc. check those messages out the NCRC may be able to help you. You are not alone in this fight but you need to do your homework. Know your enemy and join in the fight to stoplittonloannow or LittonLoanServicingExposed, both yahoo groups. God bless you and your family, may God give you the direction and strength to find help in getting away from Litton.
