Long Beach Investments is renting out their properties with an illegal lease agreement. The lease is a month to month and they added in an addendum to the lease stating that if the tenant moves out before one year, the security deposit will not be refunded. California tenant laws state that it is illegal to state that a tenant's security deposit will not be returned.

I leased a 3 Bedroom townhouse at 12562 Nelson St., Garden Grove. I was only there for 5 months (06/01/09 - 10/31/09). I moved out because there was a child molester living in the building and I didn't want my two sons near him.

When I moved out, they sent me a final move out statement stating that I owe them 743.00. I only lived there 4 months and cannot possibly incur that much wear and tear. Oh, my security deposit was $3,055.00. This is a lot of money to me.

I then proceeded to file a small claims lawsuit on them. I won the judgement without saying a word. The Judge knew that the landlord broke the law. The Judge also adjusted the move out statement and was only charged $333.02 for normal wear and tear, and also fined the landlord and extra $600 for bad faith in not returning my security deposit. My judement is for $3,321.98 + $50 (court fees).

The judgement was on 01/27/09. The landlord has 30 days to pay the judement. I have called them and asked them politely if they are going to pay, but they keep refusing to pay me. I will call them tomorrow, 02-02-09 to ask one more time before going back to court to file for a Memorandum of Costs.
