The car was sold as used but still under warranty. It was obvious that the car had been in an accident after closely examining it. The rear door on the drivers side did not line up and there was body puddy all over the mat in the trunk area. The bumper also was not smooth. I had already asked the dealer if the car had been in an accident, much like they asked me on the vehicle I traded in.

Was the vehicle you purchased new or used?
In Florida a dealer is not obligated to disclose damage on a new car unless the cost to repair is more than 3% of MSRP. I believe it is 3%, but it is a certain % of MSRP.
For used cars, unless there is frame damage, salvage, flood or other catastrophic event dealers are not required to disclose it either. Anyway, how are they supposed to know if it was in an accident? It's not like every accident generates a police report or insurance claim, which is where Carfax and AutoCheck get the majority of their data.
