Mary Ann Merva - RE/Max Bayside Properties rip off by misappropriating funds Englewood Florida
On April 1, 2004 I entered into a sales contract which provided for a real estate commission of "(a) 15% of the total purchase price provided the purchase price is for not less than $30,000.00 and closing occurs not later than 30 April 2004; or 10% should the purchase price be less than $30,000.00 or closing occur between 1 May 2004 and 30 June 2004."
The closing agent received all necessary documents signed by me at 10:07 a.m. on April 30, 2004. When I telephoned the closing agent on the afternoon of April 30th to confirm that all had gone as planned, I was told that the buyer would be in on May 3d to complete the closing. I explained to the closing agent and telephoned Mary Ann Merva and reminded her that for her to earn 15% commission, the closing was to occur not later than April 30, 2004, which as was provided that funds were to be wire transferred to my account.
Closing is defined as "A final meeting of all parties involved in a property transaction during which the transaction is consumated. In real estate, closing includes the delivery of the deed, financial adjustments, the signing of notes and the disbursement of funds necessary to the sale or loan transaction."
The closing agent was notified by fax on April 30, 2004 that due to the failure of the property to close as provided in my contract, I expected $1500 additional as to what was in the closing papers I had signed on April 29th. They failed to respond and failed to send the additional $1500.
The funds were wired to my account on May 3, 2004 and received in my account on May 4, 2004.
Both the closing agent and the real estate broker have ignored all my correspondence.
