Mr. Matt Smurr/Smurr,Inc. abandoned the jobsite and failed to complete the job and repair/replace defective materials and workmanship:

a. Failed to complete the cabana

b. Failed to install the correct type of material cabinets that are had a fire resistant insulated sleeve in grill area

c. Failed to design the cabinets for the correct depth and width and length for the appliances

d. Didn't install granite countertops or kitchen appliances and missing kitchen sink. Didn't hook up water,sewer,electrical,and gas.

e. Didn't complete flooring by grouting.

f. Didn't complete the bathroom and we are missing the comode and sink and lights and fixtures

g. failed to complete the fireplace: did not grout stone,didn't fill in area around fireplace,didn't complete the stone column

h. didn't complete the stairs with grout and didn't install or complete wiring of lights

i. didn't install the correct wood ceiling material: we paid for select grade he installed common grade

j. didn't repair decking

k. didn't clean up job site

True and Accurate Story about Matt Smurr/Smurr,Inc.

My name is Tracy Stein-owner of said property in which Mr. Smurr/Smurr,Inc. were contracted to work on various projects/improvements on our property. Mr. Smurr/Smurr,Inc. responded on this website and made some false and inaccurate statements about events regarding our project. On Wednesday,January 30, 2008 walked off our job site and refused to return our many emails,phone calls,voicemails,and faxes. We were informed by several General Contractors/Subcontractors that the work that Mr. Smurr/Smurr,Inc. conducted on our property was not in accordance with commercial/professional standards and would have resulted in a fire hazzarad and not passed inspection we had the legal right to discontinue his services. Subsequently on Feb. 7, 2008,we filed suit against Mr. Smurr/Smurr,Inc. for breach of contract,failure to perform,failure to complete work,conducted substandard,deficient,and commercially unacceptable work,failure to pay subcontractors,and etc.(Case No. 2008-CA-002581-0 Orange County 9th Circuit Court). Additionally,we filed a complaint with the State of Florida Department of Buiness Professional Regulations,and the DBPR has started an investigation against Mr. Smurr/Smurr,Inc. We never refused to pay Mr. Smurr/Smurr,Inc. for any services. Mr. Smurr/Smurr,Inc. failed/refused to provide us with invoices of extra or any worked conducted on our project. We have sufficient documents to support that we asked for documentation. Prior to Mr. Smurr/Smurr,Inc. we never had a situation where a general contractor or subcontractor walked off the job,used inappropriate materials or conducted substandard work.failed to perform or breach the contract. Mr. Smurr/Smurr,Inc. did put a lien against our property;however,the courts will determine this lien to be invalid/possibly fraudulent. We want Mr. Smurr/Smurr,Inc. to reimburse us in the amount of $31,500 (+)plus all legal expenses to bring the complaint against him and defend our self against multiple liens by subcontractors. Please note Mr. Smurr/Smurr,Inc. informed many subcontractors to put liens against our property,fortunately all liens have been dropped by subcontractors because they were classified as invalid. My name is Matthew Smurr , I am a Licensed General Contractor with the state of Florida, and my company name is Smurr Inc. I feel that I should respond to the accusations to this report filed by Tracy Stein. Mr. S was notified that Smurr, Inc. was stopping all work because he refused to pay for extra work that he had asked for. Mr. S then left me a voice message that if I stepped foot on his property he would have me arrested for trespassing. Mr. S even called one of my business associates and told him that the FBI is looking for me. I recorded a Claim of Lien for the monies that he, Mr. S, owes me in the amount of approx. $9000. I fully performed my obligations under the contract with him up to the point that he refused to pay for extras and his threat to have me arrested for trespassing. All work performed by Smurr, Inc. for Mr. S was approved by him before the start of each portion of the project. I have been in the Building Industry for of 30 years and never had a situation like this one. The only thing I wanted Mr. Stein to do was pay me for the extras that were due to me, which he refused to do. The lien of $9000 is only for work I completed. Thank you for reading the truth.

The total estimated cost to finish the job and correct all his poor workmanship is $25,000-$35,000 plus legal fees,court costs,and etc.
