Frank Bendana contacted me about putting on a Car Show at the Meloa Cafe once a month, I meet with him explained the deal and told him that the DJ would be $250.00. I received an e-mail from him saying that was great and he agreed to the deal.

I made 1000 flyers handed them out for a month advertized his cafe and then he stiffed me. My mistake was in trusting him I went did the show and then he would not pay. I am going to have to sue him to get the money he agreed to pay.

My reply was not one of ignorance. It was truthful and to the point. Employees are given pay checks (when they can get them) when there are not funds in the account. It is common knowledge throughout Melao that the waitress Angilica is not employed legally, and has been exploited because of that situation. When she complained about not wanting to work a double shift two days in a row she was quickly reminded of her status. It's against the law to employ illegal aliens. Pointing out that a business is doing something illegal, does not make one a racist. I'm sure the city of Cutler Bay appreciates Mr. Bendana's efforts to revitalize their city with this establishment. Perhaps my next letter should be to the townhall there to see what their views on some of these issues are. Thank you for pointing out how ignorant and racist I am when I only was expressing the truth to someone who was ripped off.

You must be one of the owners of Melao Cafe. Your level of ignorance was measured when you posted your comments, do you really think people are that stupid not to know you must have a vested interest in the Meloa Cafe. If the Meloa Cafe thinks that I did not tell the truth in my report then they should take me to court and try to hold me monetarily liable, but they would lose. I could always bring a copy of the Insufficient Fund Check they gave us. If any one is unprofessional it is you, Why are all your comments about stupidity, ignorance and uneducated people, is that beacuse you are. I was not denied compensation for poor performance like you suggest and business was generated from this event, if you would like the names of the Car owners that came out of the Melao Cafe and told me that the Melao Cafe would not honor the 20% discount that was agreed to by Frank call me, I am sure you have my number at the Cafe. All of your slanderous comments are uncalled for, I just wanted to be treated fairly and to get paid what was agreed upon. When Frank came by to make the check good yesterday, he ask if I could do something about this report, I can say that this matter is settled as far as I am concerned, he paid what was owed and I learned a valuable lesson, you can not trust everyone.

Ripoff Report is an excellent service but I feel that the promoter for the Car Show event may have been a little unprofessional in the handling of this situation. There are plenty of avenues to follow in the handling of a dispute such as the many legal alternatives available through our great democracy. Ripoff Report should have been the last resort when all other alternatives were exhausted. It shows ignorance and cowardice when a disgruntled, uneducated ex-employee or vendor attempts to defame the character of an establishment in such a way where the reputation of an establishment or in this case a specific individual is attacked without warrant. The level of ignorance is measured when the subject who posted this defamatory comment does not realize that at their own will they also put themselves at Jeopardy of a lawsuit for defamation. Although she perceives herself as a victim, the courts may find that her response is not only harassment but damaging to the rightful course of business and can be held monetarily liable (dont know any attorneys who will defend at $250). Mr. Bendana is a very well known businessman in Miami Dade County and his newest efforts in revitalizing the Cutler Bay Area with this new establishment is very much appreciated. Cutler Bay is changing and in a matter where change is involved certain people will look to stop progress to maintain the comfort of their own ignorance. Anyone with intelligence will note that the first complaint was that of a childlike personality who was denied compensation for poor performance. 1000 flyers she promoted and 10 people showed up and no sales were generated because of this venue. The second comment by the obviously disgruntled racist ex-employee is......well excusable. Ignorance breeds stupidity. The allegations of undocumented workers is frivolous and is an attempt to attack the fact that the owners are of a different race or culture (Legally American). Nonetheless, Melao Cafe attracts many of the residents of the City of Cutler Bay and provides entertainment to all residents of the city unlike many of the previous establishments who cared to cater for only one type of clientele. Thanks to the Ripoff Report for being an advocate for the small person but I hope that in the future further inquiry is utilized before allowing such comments from being placed. In the cases of Big Corporations the small person may get frustrated while trying to handle a dispute but in this case you are attacking a small business that provides many local individuals with opportunities to earn and serve the community in which they live in. The owners are not hidden on the top floor of a skyscraper they can be found serving their clientele right at the establishment location. Stop by and Say Hi.

Donna, I saw your car show display on the date you were there. I am not at all surprised that you were not paid. No one is being paid by this company! They now purchase all of their food at Publix or BJs and are purchasing their liquor from the liquor store next door, because they are not paying the companies that normally deliver these goods to restaurants. The employees are given paychecks that they can not cash, signed by Frank Bendana. Additionally they have undocumented immigrants employed whom they do not have to pay-- they are happy to work for tips. (They never collected a single social security card from any employees) I don't know if you noticed when you were there, but there probably were very few if any female employees, the sexual harassment is ever present. I don't expect we'll see the doors of this establishment open for much longer. I'm sorry you got ripped for $250, but get in line!!

As soon as they found out that I had put them on this site, they called and wanted to pay what they owed me.
