I had my carpet installed by AMERICAN CARPET AND TILE, Inc. in Stuart, Florida.

To start it of the installer was a young kid who brought his girlfriend along, they ended up getting into a fight and she peeled out of my driveway. The installer was so mad, he ripped the seam of my carpet when he was almost finished. It took weeks to initially get the carpet.

He ended up repairing the mistake. The owner issued me a letter that stated if at any time I am unhappy with the repair, they will REPLACE the living room carpet. I was ok with that, at the time I had a baby and we had to move in the house.

A few years pass and the seam is coming up. I phoned Mr. Mannion and explained the problem, he said he would have someone come out in a few days to look at it and he would call me back. He never called, I had to call again and he sent someone out a few days later. The installer came to look at it and was shocked at the installation. He told me that I had a good case, but that the owner was going to give me a hard time. I told him that I was prepared. That was a Friday. Mondays comes around, nothing.

Tuesday morning I phoned him. He said he would repair the mistake..I told him I wanted it replaced, he said no and hung up on me. I called him back from 3 phones one right after another and he never picked up. I left a message on his machine, stating I will be up there in 15 min to speak with him.

About an hour later, I showed up at the business. I walked in and asked him if his name was Michael. With hesitation, he said "yes". I gave him my name and told him I was the one he had hung up on this morning. He was speechless, claiming it was an accident and he tried to call me back but the number was old. I asked him what are we going to do about this.. He played stupid... I asked him if we should just go to court, he said yes, I'll see you in court.

If this guy would have called me back and spoke to me like a human being, I probably would have let it alone. Now days I think you need to bend over and please the customer, I don't think many businesses can afford neg feedback, much less a law suit. He was unprofessional and very rude. I think because I was a female, he figured I had no backbone and was full of it.

Needless to say, because he was such an a*****e I went to the courthouse and gathered up my paperwork for small claims court!

Oral Promises Not Enforcable

You're not going to have any case for a full carpet replacement after several years, because - for starters - the oral promise is NOT enforcable after this period of time.  The second issue you're going to have is that the carpet is now years old and has suffered depreciation during that period.  Even if you could somehow prove the guy should replace the value of the carpet, you would only get the undepreciated value of the carpet.  Most carpets would be considerd fully depreciated in about five years which means - at most - you will get 40% of the value and that's ONLY if you can prove the oral agreement as enforcable.

At this point, your case is definitely full of it.  Your window of action was at most 3-6 months, not 3-6 years.  But this is Amerca and you have the right to have your head handed to you in court.  Best of luck....

How can you expect the owner to replace your living room carpet that is several years old????  No matter how poor the installation was, or how bad the carpet was ripped.

Your demands that the owner will replace your carpet were unjustified.  The owner's offer to fix a carpet job that was several years old was more than fair.

I think you are trying to replace your worn out living room carpet at someone else's expense.

to Whom it may concern:

I cannot believe you would expect this company to replace carpet that was several years old.  I can understand him wanting to repair the carpet, but replace it??????

If you wanted to have the carpet replaced, you should have done so within 3-6 months at the most.

you should  behave more reasonably.
