9/9/2015 I placed a $100. deposit on a 2000 kia Sportage EX as listed on Craigslist (Roanoke,Va.) vehicle was stated to need only a battery and left rear tire. When I looked at the vehicle Michelle Wright told me again just battery and tire were needed and that she had many calls on this vehicle and she said she would hold it for me . I then gave her a $100 and received a receipt hand written and signed by both myself and Michelle stating that this was conditional based on verification of stated condition .

We agreed that I would come back in a couple days with a battery and some tools to check the running/operating condition of this vehicle. I checked the Vehicle Identification #(VIN#) on line that evening through VinCheckPro on line. The VIN# revealed that this was a 1999 Kia Sportage EX . I talked with her and told her what I found out. I told her I would be unable to pay her asking price because of this! Michelle said we could talk when I brought the battery. 

9/11/2015 I met Michelle at the vehicle and installed the battery ,after 5-10 minutes trying (starter intermittently engaged) it started and I found the following problems:

1. starter intermittent operation

2. alternator low output voltage (would not keep battery charged 

3. air conditioning did not work

4. all dash lights,temperature gage and hazzard flashers did not work

5. Vehicle smelled like burning wiring

6. massive exhaust leak at catylitic converter and vcheck engine light on

7. drivers side rear window intermittent operation 

I told her that not only was the vehicle a 1999 instead of advertised 2000 but had all these problems when she told me only needed a battery and tire I could not purchase and needed my $100. deposit back! She agreed she would return the deposit by 9/12/2015. no contact/response to calls I placed on 9/12/2015 .9/13 she called said had a death in  family and could not return my money for another week. I accepted this and again no contact no money all my messages went directly to voice mail. Finally she answered my call and stated she would have the money returned by 9/22/2015  as she started a new job,she told me I would have the $100. back for sure on 10/02/2015. Again no call or contact ,so I continued to call using different phones till she answered on  she said that she would get the money together in a couple days> no contact or response from her since it is now 10/14/2015. 

I have not heard from her at all and she will not answer my calls! I would like to get my money back without causing problems for her and minimize any costs for court etc. Please Help me!
