In 2002 we volentarly surrendered a vehicle that Ford Motor and the dealership refused to honor the warranty for a fautly transmission since it was 52 miles over. Also, keep in mind this vehicle had been in for all kinds of issues and I have service reports to back it up.

NOTE: Most Ford dealerships will "GOODWILL" a warranty and fix it to keep consumers happy and coming back. They simply contact the area rep and get approval and honor the warranty. This is usally a one time thing unless it continues to have the same issue over and over.

The vehicle had 2000 miles on it when it was LEASED. This was A RCO Lease with OPTION to buy. After several failed attempts to get them to fix it for us and honor the warranty we had no choice but to surrender the vehicle because we could not afford to pay for the repairs.

So this went on our credit report file. In 2006, 4 years later we were trying to clean up our credit and discovered that MIDLAND had reported that we owe $9,690.00. I was so angry because we had not had one call or letter from them and no we still lived at the same address.

So,........I started my own little Investigation and discovered that the transmission had been repired under our warranty before we surrendered the vehicle! I did this by simply asking a friend that works at a Ford dealership to pull the service report using the veh vin #. And there is was, I was so shocked! I was told it was repired under a PO5 code which means it was repaired our warranty!

So, I started writing the 3 credit bureaus around the end of June 2006 and submitted my proof. I also wrote a letter to Ford Credit, which I have not heard back from. And I wrote to Ocwen that was handleing the file for Midland.., that sounds funny to me. Ocwen sent a letter saying they were closing the file and they sent it right back to Midland.

So, I recently received a letter from Trans Union and they deleted it on 8/16/06. Two days later I receive a letter from Midland offering a settlement!!?? So here we go again, I am so tired of the Debt Junkies........this should be illegal. So my question is..............can Midland sell that debt after Transunion deleted it? And can a new company try to collect and do I have to do all of this all over again? It drained me, I have a family and I can not continue to hassle with them. Oh, They are now using Midland FUNDING LLC. How can I get these PITA's to go away for good??? Does any have some helpful info for me? If you do I would appreciate it so much!!!! I'll keep you all updated on my battle with them............I may have to hire an attorney. FYI; As of today, the 24th of August,I have not hear from Equifax and Experian yet on their deciaion.

Today I called Midland to follow up on the information I faxed them a week ago. I talked to a very nice lady in the consumer affairs dept. I told her that the debt had been deleted from our Transunion credit report but I haven't heard back from the other two yet. And she aksed me to tell her the whole story again so...........once again I repeated the story to her which I have done so many times over and over and over. Anyway, after I explained what took place I asked her what steps do I need to take to prevent them (Midland) from selling the debt to another collection junkie. She told me to call the FTC and request a fraud affidavit and to fill it out and have it notarized and fax it to them and they will delete it with all three credit bureaus. She gave me her word that it would not be sold to any debt collection companies. And she said she would fax me a letter to confirm that once she receives my fax. I hope and pray this is the end of it for good. And I certainly hope that my story helps someone else out in the future. I verbally reported my statment to the FTC, but you can file a claim online with them. The FTC was very helpful! Good luck to those of you that have the same or almost the same issues as me. Just don't give up and check your credit once a year. I learned the hard way..

that once the account has been disbuted and taken off your credit report, then it can not be put back on there again by another company. I may be wrong. I know I had a repo back in 1994. After 7 years, it was taken off of all 3 credit reports. I do however, still recieve bills from them. So maybe they can sell your account and still try to collect from you. Sorry, I can't answer your question. I'm kindof curious about that now. Anyway, good luck.
