Midtown Moving and Storage was contracted to remove my property as a result of an eviction and paid to take it to their storage facility. The property was with them for 3 months. After going to court I was given back my home.

 The day I received my keys I went into the house before going to retrieve my property and their was broken funiture everywhere! I had been to Midtown's warehouse 3 days prior and paid $1,500 for the 3 months of storage.

Upon arriving at the facility with my uhaul I was told to get my property I had to sign a release that stated I would not sue them for broken, lost or damaged property. I refused stating I already knew they damaged my property and everything on their inventory stated broken, EVERYTHING! On the Marshall's Inventory nothing said broken.

When I refused to sign the release, which you are not required to by law, they refused to give me my property! I sued them in Small Claims Court and Won! The Judgement states that the Judge did not find them credible, that they tried to extort a general release from me, which I'm not required to sign and gave me a judgement of $4,390.35, which they had 30 days to pay and have not paid to date.

I have read two report very similiar to mine, however one thing the other's did that I didn't was sign that release, which waives you right to sue them. NEVER sign that!

I think this site is great were you can report a business, but thats not enough. This business is licensed by the Department of Consumer Affairs and The Department of Transportation. You need to file complaints with them. Also contact the Better Business Bureau as well.

I also sued my Landlord, and Landlords need to be held accountable for the companies that they elect to do business with. If your property was lost, stolen and damaged, sue the LandLord as well, they have an obligation to safe guard your property, even if you was evicted. If they continue to use a business that is not doing it they should be held responsible too!

If you ever have to deal with this company, get a Marshalls iventory, which will always be different from Midtown's cause their crooks! Don't sign that general release and don't believe them when they say you have too! Sue them in Small Claims Court for you broken, lost, stolen items which their will always be, because their incompetent crooks! And report them to licensing agency's!
