To Whom it May Concern:

I need your assistance please. Hired Arley Leghorn (AL) to build an engine. My first contact was via phone about September 2008. I located AL's company on eBay. Although his ad stated a price of $1295.00, we agreed on a price of $1199.00 including a $195.00 shipping fee, a refundable $495.00 core charge, and $100.00 for the core return shipping fee.

I informed AL that I wanted internal upgrades. Therefore, I sent him $1200.00 worth of internal engine performance parts (receipts and tracking numbers). AL has taken 9 months to build my engine, or so he states. However, AL recently, 4/6/09, informed me my engine was being built in Los Angeles not in San Mateo where he led me to believe his operations was located, and where I sent the parts. He stated he would send the engine on 4/10/09 with the invoice but obviously I never received either.

After the initial contact to earn my business, AL has never once contacted me on the update of my engine nor did he let me know when it was supposedly completed. AL and I are at a stalemate due to his non-transparent behavior, e.g., will not tell me where the engine is located for my inspection, will not list the items I sent on the final invoice, example; I have asked AL to list the items I sent by name brand on the invoice.

One of the items AL listed was pistons when I sent Wiseco Aluminum Forged Pistons. There is a huge ($) difference. AL is demanding a money wire transfer, or cashier's check when his ad clearly states Motortime-biz accepts credit cards. I also stated that he could use the waiting period if needed to make sure the funds transferred. AL informed me and my mechanic that he will not warranty (ad states 12 months) the engine unless I sent all new parts.

Now he is stating he will not warranty the engine. AL has been horrible to deal with including hanging-up on me, using curse words, and undignified tone of voice. I have never been inappropriate when it has been my right to be; only illustrating frustration for I hope you can obviously understand why. I tried mediation via San Mateo, California's Judicial system (small claims) but he ignored the request.

At this point, I can only assume AL's evasive behavior illustrates a person stealing. I do not even want the engine anymore. I just want my parts returned in unused condition, or the $1200.00 I paid for the parts. Also, I will further pursue action so he does not steal from anyone else. I am sure this is not the first nor will it be the last unless he is stopped by appropriate authorities. Your immediate assistance concerning this matter will be greatly appreciated.
