I have the same problem with Mulloney, Jeffrey, Rooney, Flynn. I called the ATTY General on them and FDC. The Atty General is sending out a complaint form for me to fill out. Any one who has had an issue and wants to make a difference contact the ATTY General at General Helpline: 1-800-771-7755 back. There are many collection law firms being investigated because of these problems. I am lucky to have a lawyer in my family which still has not made this mess any easier. But what about people who have no clue they broke the law. Please contact me if you have been in this situation with these guys.

Hi, I am having the same problem with these people. I am being harassed every day by them. They call 7 in the morning asking for me. I asked them yes you do have my name correct and my address correct.. but what is my SS. NO answer. They got my name out of the phone book and are now playing these games. I have even spoke to one of the lawyers and i was told, it was there mistake and they will take care of it. Next month i get summoned to Cort.They make up a differ story every time. I even have them recorded. Nikki I wish you best of luck. If it wasn't for you i would not plan on going to court my self. Thank you for this post. Perhaps we all can help each other. To the person who was asking how to file an order to vacate judgemet-google it! I did not use an attorney for that part-I just googled it, called the court house and faxed it to them Good luck!

I had same situation- They pretend that they served you, (twice) - consumer is a no-show in civil court-they get the judgement, send it to all banks in NY-and sheriff- to freeze you assets if any are there. I am curious has to how many "orders to vacate" have been filed against them in last 3 years. with the same scenario-(cirmustance for circumstance). However, the debt that they claimed against me, was from 1988, - Im so glad I never throw anything out...In my mortgage documents was a statement drom the original company, that this was in error. So, I too filed a "show cause", - but with a Counter-suit. I then - served them. (with the answer, a copy of the document that I kept--thank goodness, and asked that they give me, all charges for returned items, send statements to my creditors explaining them as the cause for returned items, -- loss of interest, pain and suffering, as a single mom, head of household, who did not have access to any funds during they time it took to file and get notice to show cause. as I said to judge, (I have in my possession a valid legal document proving this not to be a debt, and it is from the original creditor) So, who were they representing? and if they had sent any notice, I would have simply produced the document. So this proved, a. they never served anything. b. they were working off some bogus details from 1988....and it was 2008. The Attorney General needs to look into MJRF. Now!

I am having problems with this company as well. Today I tried to get an apartment, and when they ran my credit they reported this and told me it looks extremely suspicious. I haven't lived in New York since a brief stay in 2003, never in schenectady where they say this happened, and have never heard of Mullooly, Jeffrey, Rooney, and Flynn until today when I found out some charge they bought from someone I've never heard of for $864 in 2003 jumped to over $3,000 dollars in February 2009. I am unable to get in touch with anyone in their offices, and am really confused and kind of freaking out about this whole thing. If anyone can help please I could really use it. Thank You David

Nikki: Now in the same situation you were in, we'll be engaging our attorney, already sent a certified letter to plaintiffs attorney to validate debt, and will be going to the Court's clerk office in the to get all paperwork submitted that awarded them a default judgement How did you go about filing the 'order to vacate judgement'? Did you get the paperwork or form from the clerk's office and if so, how much to obtain and/or file? Can it be done via certfied letter to the Court, attorney, and Marshal's office? And this was done on your own, right? No attorney? Like to do some legwork on my own before fully working with our attorney, any helpfull webites out there in regards on filling the order to vacate? BTW, for you New Yorkers, can we file 'Claim of Exemption' and 'Financial Statements; against the Earnings Witholding Order (EWO) in order to either eliminate or lower wage garnishment? Thanks in advance...

J G Shrugged,Austin, Texas, U.S.A.---Please check your facts. I did get a check for aprox $1000 from the "law firm" without doing any of the things that you say would make it possibe for me to get the check. I called the "law firm" and basically told them that I knew that they had committed both fraud and perjury and on top off all that, they had a case of mistaken identity. I write a letter to them detailing all the expenses that I incurred dealing with THEIR mess (time off work, gas for travel to and from the city court house, attorney phone consulation fees etc) and I got a check for 900 and something dollars! The reason why they paid the money is that they knew that if I sued them, which I had every right to do, they would end up paying me. They never served me with a summons, so by claiming that they did, and getting a judgement, they had committed perjury. Also, on the fake summons that I supposedly signed, there was a signature so one of then committed fraud by signing on my behalf and the list goes on. They knew that if they had to answer to all those charges in court, they would be in a very bad situation. If they are indeed attorneys, they could be disbarred. I reported them to BBB, FTC and the Attorney General AFTER they sent me my check. In summary, if this happens to you, the first step is to get a copy of the judgement from the court house. More often than not, they will have claimed that they served you with a summons even though they didn't. Check the debt to see if it is even yours or if it has not exceeded the statute of limitations. We have an obligation to pay our debts(if indeed we have incurred them) but we all need to abide by the laws and companies like Arrow Financial, Mulloly Jeffrey et al tend to ignore the rules and bully people because they count on YOUR ignorence. I am more than happy to answer any more questions about this matter---I am not an attorney or any legal professional but I took it upon myself to eduacte myself about this matter and in the end, I won the battle!

read what this consumer advocate has to say about Arrow Financial. The website exposes the nasty ILLEGAL TRICKS Collections use. So collection agencies do not want you to know about this site Some of those tricks used include phony service on summons as you experienced and falsefied documents filed with the courts. YES they use those illegal tactics in court as well.

It makes no sense that they would agree to it. Also, you would probably have no standing to sue them separately for this - all the default judgment does is start the counter back to zero - on the original court case. So they would serve interrogatories, etc. You would probably need to file a counterclaim against them in the same lawsuit, otherwise you're probably out of luck since the original matter would have been adjudicated. Did you see a local attorney?

i had the exact same thing happen to me..yesterday i woke up checked my bank account.and there was a lean on it from the mullooly people..i didnt owe anybody any money,as a matter of fact i have proof that i paid all my debts..and i also never dealt with the arrow company either..apparently mullooly have an imaginary account that i owe..so they over drew my bank account by almost five thousand dollars..i spoke to a man named mr.bar from the mullooly firm he told me he was the attorney handling my case..i had a friend of mine who is an attorney call them ..and come to find out mr.bar is not an attorney,my friend asked to speak to a attorney who works there and no one could give him a straight answer,then they told him that there weren't any attorneys persently in the office so they would have to call him back.but no one ever did...i would appreciate any help u can offer and i hope maybe i was of some assistance...

NIKKI-LOWELL< MA So I filed the "order to vacate judgement" and my bank account was unfrozen and all the charges assesed by BOA were reversed. It took hours of telephone conversation, 3 or 4 trips to the local branch, dealing with the Court in Albany, Telephone consulation with attorneys and a lot of research, but it was all worth it in th end when about 5 days later I started to see the money come back. Mullooly Jeffrey and Flynn have agreed to reimburse me for all expenses incurred because of this mess and am still waiting on my check-I will re-post when/if I get it. (check amount = almost $1000) IF I DO NOT GET THIS CHECK WITHIN THE NEXT WEEK, I WILL SUE BOTH ARROW FINANCIAL AND THIS LAW FIRM AND I WILL REPORT BOTH OF THEM TO EVERY AUTHORITY THAT I CAN FIND; BBB, FTC, NEW YORK STATE BAR, JUST TO MENTION A FEW.
