here is an email i just received from oryan management. Looks like we all have to amend all of our returns:

Dear Member,

Enclosed is a copy of a permanent injunction, entered against me on May 3, 2004 by the United States District Court for the District of Nevada. The injunction requires me to post a copy of the injunction on my website and also requires me to provide all customers, including you, with a copy of the injunction along with this letter.

This injunction bars me and others from making false tax representations in the future, and specifically bars me from "organizing, promoting, or selling the Mallforall, Shopn2000, or TaxBreak2000 website programs or an arrangement that facilitate or advocate noncompliance with the income tax laws or tax evasion or misrepresent the tax savings realized by using the arrangements." I am also barred from stating that website owners "may claim the 26 USC&44 disabled-access tax credit and &162 trade or business expense on their federal-income-tax returns, even if they have no bona fide business, the expense is not reasonable and necessary, or the business modification is sold along with the business itself."

The Mallforall and Shopn2000 websites were marketed as being eligible for a $5,000 &44 tax credit and $5,475 &162 tax deduction. If you have filed a federal-income-tax return on which you claimed the $5,000 &44 tax credit and/or the $5,475 &162 tax deduction, then you may be required to file an amended federal-income-tax return because these credits and deductions are not allowed.

The IRS is disallowing deductions and credits related to the website "modifications," for which you paid. The IRS is also disallowing any claim that the promissory notes are bona fide debts. You may be subject to additional taxes, interest, and penalties for claiming these credits and deductions. Further, you should not claim any related carry forward credit or deduction on any future income-tax returns.

If you have any questions regarding your previous or future income-tax returns, please consult a competent professional or contact the Internal Revenue Service.

Best Regards,

Robert Goetsch
