I am a non attorney employee of this firm. I can believe everything that this lister said and more. I have worked for the firm for over four years and have the inside scoop about everything and anything from sexual harrasment cases sweaped under the rug by our human resources department to credit reports being pulled on debtors parents. I am legally blind and my rights under the ADA have been violated as well. I have filed two complaints to the EEOC and one breach of contract as well as a ethics complaint with the Georgia Bar Association. GEMA as it is known in the office is a multi million dollar business and deserves to be brought down. Their internal staff is a joke and should be held accountable for breaking the law. We had a manager named Tara that broke the law so bad that they had to do a full investigation to find out the extent of the violations. If their is a ADA attorney out there that will take this case on then please call me. If there is someone in the media that is willing to help then do the same. Any questions about a account that your listers may have call me. I need help to fight them and bring them down. If anything in this rebuttal needs editing then do so and send me a copy to approve. I have the inside scoop.

Aafes, The poster was totally correct. Freedom of speech protects bad taste. The law you posted applies ONLY to the party PLACING the call, NOT the person recieving it. The scumbag at NCO had no grounds to file any complaint. If the NCO scumbag does not like what is being said, he has a good option. DO NOT CALL ANYMORE! Very simple. I have used this many times as you have to lower yourself to the level and mentality of these crackhead retards so they can understand what you are saying. I even put my insults on a collection letter they sent me and fax it back, perfectly legal! You know why? They contacted ME and ASKED for a response.

I didn't know it's against the law to call someone a derogatory name. I also didn't realize that it's against the law to call a black person the n-word, etc. I am aware of PC 653M, and I would never threaten physical harm to someone. However, these collectors need to be put in their place because they are garbage men. This jerk called me about a debt that wasn't even mine, as I looked at my credit report on a regular basis. As far as posting my court documents and case number...I don't want my information circulating around the web, but I will tell you it was filed in the Kern County Courts up in Bakersfield. If someone calls me and harasses me on the phone, you can bet the family farm that I will harass them back. I have no problem yelling racial slurs, because nowhere in our state laws does it say it's illegal to be a racist.

Your advice is not only unfounded in fact, it is not a wise choice. One thing you can count on with this collection agency, they also recorded the call. You stated what you did was legal, I contend it was not. California Penal Code 653(m)- Obscene, threatening or annoying communications (a) Every person who, with intent to annoy, telephones or makes contact by means of an electronic communication device with another and addresses to or about the other person any obscene language or addresses to the other person any threat to inflict injury to the person or property of the person addressed or any member of his or her family, is guilty of a misdemeanor. Nothing in this subdivision shall apply to telephone calls or electronic contacts made in good faith. Additionally, you have no knowledge, via telephone of this person's racial identity. You both were wrong in your speech and actions. You said you filed a lawsuit and won. I doubt your claim, and would be very interested to see the court documents. Do you care to post the case number and county for all to look at the court ruling?

Wellington I admire your boldness with that idiot collector but be careful brother. Your lucky the collector didn't call the police right away and file charges against you for a hate crime. I hate collectors just as much as you do but do it legally bro. By the way...Congratulations for winning the case! :)
