MY NAME IS KYLE CAMPBELL. I AM THE MANAGER OF NEW AGE AUTO GROUP. I AM THE PERSON WHO DELIVERED THE TRUCK. I PICKED UP THE COMPLAINTENT FROM DFW AIRPORT. I HAD SOMEONE FOLLOW ME TO GIVE ME A RIDE HOME BECAUSE THE CUSTOMER REQUESTED THAT I DROP OFF THE VEHICLE AT THE AIRPORT TO SAVE HIM SOME TRAVEL TIME. I PICKED HIM UP AT THE TERMINAL. HE DROVE THE TRUCK. HE FOUND SOME THINGS THAT HE DID NOT LIKE ABOUT THE VEHICLE. IT WAS STATED IN THE AD THAT THE TRUCK WAS IN AVERAGE CONDITION FOR THE YEAR AND MILEAGE. IT ALSO STATED THAT IT HAD MINOR DENTS AND SCRATCHES THROUGHOUT. NOW KEEP IN MIND THIS IS A FOUR WHEEL DRIVE DIESEL TRUCK WITH 178,000 MILES. IT IS GOING TO HAVE SOME SCRATCHES AND DENTS. AFTER HE DROVE IT HE NIT PICKED EVERY LITTLE DING AND NIC ON IT. AFTER TALKING TO HIM FOR AWHILE HE DECIDED THAT FOR $1500 DOLLARS HE COULD MAKE THE TRUCK THE WAY HE WOULD LIKE IT TO BE. I FELT THAT THIS WAS RIDICULOUS SINCE HE WAS WANTING TO RESTORE THE TRUCK TO SHOWROOM CONDITION, BUT HE BOUGHT IT WITH THE UNDERSTANDING THAT IT WAS USED, HAD ALOT OF MILES, AND HAD SOME SCRATCHES AND DINGS. HE SAID IF HE WAS GIVEN THE $1500.00 THAT HE WOULD BE HAPPY AND TAKE THE TRUCK AND LEAVE POSITIVE FEEDBACK. I AGREED TO THIS, HE SIGNED THE PAPERS, I GAVE HIM THE MONEY, AND WE PARTED WAYS. I LEFT THINKING THE CUSTOMER WAS HAPPY. I NEVER CONSULTED WITH AARON AS STATED. AARON IS A SILENT PARTNER IN THIS BUSINESS. I MAKE THE DECISIONS, JUST AS I MADE THIS DECISION. HE DID NOT COME TO OUR LOT THE NEXT DAY TO COMPLAIN TO AARON AS STATED, I WAS THERE AND HE DID NOT SHOW UP. A FEW DAYS AFTER HE RETURNED HOME IS WHEN HE STARTED CALLING DEMANDING MORE MONEY. I TOLD HIM THAT I COULD NOT DO THAT, BUT IF HE WAS UNHAPPY HE COULD RETURN THE TRUCK AND I WOULD HONOR OUR EBAY GUARANTEE. HE STATED THAT HE WOULD NOT RETURN THE TRUCK, THAT MORE MONEY WAS THE ONLY RESOLUTION HE WOULD AGREE TOO. HE SAID HE WAS GOING TO HIS LAWYER, AND I NEVER HEARD FROM HIM AGAIN OTHER THAN THE OCCASIONAL HARASSING EMAIL. THERE WAS NO FRAUND INTENDED. I HAVE OVER 90 POSITIVE FEEDBACK ON EBAY, AND SEVERAL REPEAT CUSTOMERS FROM ALL OVER THE COUNTRY. I DID NOT DO THIS BY DECEIVING PEOPLE. I DID EVERYTHING I COULD TO MAKE THIS GUY HAPPY INCLUDING LOSING $1000.00 ON THIS TRUCK. SOME PEOPLE JUST CAN'T BE PLEASED NO MATTER HOW HARD YOU TRY.

Especially one that states "sold as is". But Ebay is what will get your money back. The attorney will be helpful but what you should do is call Investigator Bryan McGee at the Midlothian, Police Department at 972-775-7712 and file a complaint for "theft by deception". That is absolutely what this fraudster did. DO NOT mention that you have an attorney working on the case. Be very clear in what you want to do. You want to charge the owner of New Age Auto (NAA) with a felony theft charge. Tell the officer that this is not a civil matter; there were no contracts involved. Tell the officer that you have proof that NAA that deliberately mislead you into turning over $14,000 in return for an item that is a fraction of the value. Fax him a copy of the e-mails as well as a copy of the original eBay auction. You have an excellent shot. He's probably done this to others as well. For all you know he may have a police record for the same thing already. This man is using the Internet to steal.plain and simple. That was obvious to me when you wrote that he didn't bother to show up with the car, he KNEW it was fraud and wanted to avoid confrontation. Good Luck The Fraud Chick
