Simply Nexgenlabsusa, aka, Dietpillusa, offered a free bottle of their product, PHENTERTHIN,(please note the close pronunciation to PHENTERMINE,

essentially a prescription diet pill) for only $4.95 shipping and handling. In the online advertisement the words "terms Apply" appeared below the price of the offer.

At the bottom of the online page the words terms and conditions was listed. Below the phase, Terms and Conditions, was only the normal FDA disclaimer. Nothing else was listed. Ok . No big deal. So I signed up for a free bottle for a friend. The free bottle came. THEN, about 2 weeks later came TWO MORE BOTTLES. I thought they had made a mistake. Did not think a thing of it until I found my credit card was billed $149.95.

I tried to call the company and ask what was up. I had not, at least, intentionally, signed up for anything but a free sample. I was asked,"Have you read the Terms & Conditions?" I said, "That's just a typicall disclaimer what's that got to do with these extra charges?"

I was told to punch up the site again and "click" on the words Terms and Conditions. Apparantly, the Terms and Conditions were hidden on another page. Nowhere in the online advertisement and instructions does the ad

instruct the user to "click" on the words Terms and Conditions, and nowhere in the add is there an indication that one is signing up for anything other than a free sample.

I tried to call on the phone and cancel the orders, which I had no idea had been placed automatically when I chose to receive a free bottle. This could not be done; the company only accepts cancellations on the web.

So I cancelled. I am waiting for there reply. I need to send back the unwanted product, but according to the hidden Terms and Conditions one can not return product. Also, I was supposed to have 29 days to cancel any orders, but before that time was u, I was sent product I did not want. I am probably stuck with the junk at about $75 a bottle.

Of course, had I been clearly instructed on how to read the Terms and Conditions by the advertisement, I would not have order a free bottle. By "hidding" the information about their Terms and Conditions, and by not instructing the buyer on how to obtain the Terms and Conditions, this firm creates the deception that the buyer is simply "trying" something, not signing up for an indefinite length program.

I was well within my cancellation period when I started to try and cancel, but phone cancellations are not taken, and the web response time is well over the advertised "within 24 hours."

I have disputed the charges on my credit card because I feel I was misled.

It seems only appropriated that one be informed plainly and clearly if they are to add another $149.95 to their monthly budget, yet the people at Nexgenlabsusa never indicate CLEARLY, that this is exactly the case. This

is an obvious attempt to sell every sucker a program and make it difficult for the sucker to canel, by allowing no phone cancellations and by sending out product before the trial time of product use is fully exhausted and therefore "trapping" the buyer into at least one purchase, that he is not aware he is making.

Yes, it is a rip-off, and yes, it is very deceptive. I will, of course, never use any product associated with this company and others should be warned. I believe that this borders on interstate fraud, beacuse the buyer

is not clearly told he must "click" on the words Terms and Conditions to read them. All the follows the words are the typical disclaimer.

Buyer beware of Nexgenlabsusa. They are internet crooks.
