We were asked to put a down payment on the deal to buy a new Nissan. We asked what amount they considered. The salesman Mike) told us since we were thinking of $2000 down then the check should be made out to that amount.

We were kept for about 3 hours waiting, when we told them we were leaving, we were sent in to see the finance officer(Garcia). His terms were unacceptable to us, at that time, we requested our check back. We were told that the check is in a timed vault which was opened once a day.

We told Garcia that we will return for that check. We returned the next day for the check and were told that it was deposited. We asked how could it be deposited since the deal was not consumated. Garcia told us that he meant that the check was deposited in his safe.

This check was cashed against our account and now we requested our money back.

Nissan of Garden City is giving us the run around. They give 1st names only,so I spoke to Frankie who told me that I would get a call within 2 hours, which I did not get. When I called and asked for the Manager, I was given the name Jim. I explained that they have already cashed my check and I need my money today. He promptly hung up on me.

I am losing money, while they are profiting on my money illegally since I requested my check back before closing the deal and leaving the dealership.
