Buyer Beware North Shore Honda!!

I had bought a Honda from another dealer in August (financed through Honda) and within two weeks it was totaled, so I started my search for a replacement vehicle.

I found one at North Shore Honda and put a deposit of $500.00 down on 9/9/2010, just to hold the car, I was financing the entire price of the vehicle so it was agreed that the $500 would be returned to me.

Here's what happened. Nationwide insurance would not pay for the totaled vehicle until they got the title for it, of which I did not have yet, so North Shore Honda decided to wait, to hold the replacement vehicle, until I got the title, basically indefinitely. So they decided to not sell me the car until they got a title. Understand I was paying for a rental and needed a new car asap and also had a letter from Nationwide stating the first car was a total loss and they would be paying and what amount so we should have been good to go.

So I called the original dealer (Atlantic Honda) and they were able to do the deal with a replacement vehicle that same day!!! They id not have a problem.

So since I didn't get the car I left a deposit on, nor did I need one now, I asked for my deposit from North Shore Honda back. I was assured by
Mike Petrosillo and Diana Devaney I would have it credited back, this was on Thursday 09/09/2010 and of course I did not receive it. This caused me to have $175 in overdraft charges, so I set out to call and email but Diana Devany ignored my calls and emails until I sent an email to everyone, the manager, sales manager etc. I then spoke to the general manager Dave Haber on Wednesday 9/15/2010 and he said he would credit me back my amount "right now" he even verified the card number on that call.

Well, it's Friday 9/17/2010 and I still have not received my funds, and now I was hit with another $70 in overdraft charges.

Everyone knows in this day and age it does not take that long to credit a payment back.

They are negligent and responsible for the $500 and $245 in overdraft charges on my account.

It was their decision to ignore the letter from Nationwide saying they will pay for the loss of the first vehicle so there is NO reason they should have opted against delivering the car, and that's not even the point here, they CANNOT keep my deposit if I never got a car from them nor do I intend to.

As a side note, they played with the interest rate, as in bumped it up, higher than the other dealer, I guess they need the money, maybe that's why they're trying to keep my $500!
