Linda I hope this helps! State Fund Supposed to Help Victims of Mortgage Fraud

I found this article today on the web. This may be your ticket! ---------------- State Fund Supposed to Help Victims of Mortgage Fraud LAST UPDATE: 1/18/2006 9:19:50 AM Posted By: Maritza Nunez Watch this story... Home loan scams are on the rise in Texas. Investigators say white collar criminals are making millions by defrauding homeowners. Yet the News 4 WOAI Trouble Shooters have learned a fund intended to help the victims of mortgage fraud is sitting nearly untouched in Austin. Brendan Gill, a lawyer with Texas Rio Grande Legal Aide, deals with mortgage fraud cases all the time. "(Criminals) can steal a lot of money before they're caught. I guess that's the motivation," says Gill. "The incredible arrogance of the fraud is really remarkablehow people can be so bold in doing it." One of Gill's clients is Joe Castellano, who nearly lost his house because a former San Antonio mortgage company called One Stop Financial allegedly promised to make payments for him but kept his loan money instead. "They almost took my house away, Castellano told News 4 WOAI Trouble Shooter Jeff Coyle last year, because (the owners were) keeping the house payments," Castellano is not alone. According to State Representative Linda Harper-Brown, R-Irving, mortgage fraud in one form or another "is a problem that has reached epidemic proportions in Texas." Yet few people know about the state program in place to protect victims like Castellano. Every licensed mortgage broker in the state contributes to a fund that is used to reimburse homeowners who are ripped off. But in the six years the Mortgage Broker Recovery Fund has been in existence, the state has paid only three claims totaling $46,000. The remaining $1.9 million in the fund is earning interest in the state treasury. "It's kind of shameful that people are not aware of this remedy and are not filing on it," says Gill. It definitely is an option because I think getting money out of the actual thieves is not very likely." To be eligible for reimbursement from the Mortgage Broker Recovery Fund, you must first win a court judgment against the mortgage broker.
