My husband and I purchased this home 15 years ago. And my husband and lost his job when the finical market was at its worst point. He wanted to open a business which he did. So we found a mortgage company that took cash out and then the mortgage we borrowed home we had the interest rate kept increasing and we could afford the loan. Then we found a loan medication that worked with us and got saved our home everything good that was about 5 years ago.   During that loan medication that only added my husband to the loan and me because due to I had purchased a house in my name for his bother and he never paid the mortgage and I didn’t know that the house went into foreclosure until we were trying to save our own home through the loan medication. So then only my husband was on the loan. Then in 2013 my husband passed away his death was a shock so horrible.

So the home now has turned into an estate under my husband’s name and I have been paying the mortgage payment but it only in my husband name. I am trying to be added to the home but Ocwen Loan Servicing has NOT been helpful at all. I have working on this since June 2013 I also have a hired an attorney for this and the only thing that was accomplished was that I am a Personal Representative and that is about it. I called the Ocwen 5/22/14 and want to know what was going on and the reason I could be added to the Mortgage loan and they couldn’t tell me the reason why. They had to mail me letter and the letter was dated on 1/28/14. Which I never received until 6-1-14 I had to request the letter. When I had called them the previous times they never stated to me anything that it was still pending. So they lied to me. So the letter I got from Ocwen stated this basically Your request for an Assumption loan has not be eligible there was not further reason and I called again on 6-2-14 and 6-3-14 and I want to get an answer and they couldn’t give me that they will have mail me an explanation on why that will take up to 15 days. I just want to be added to the loan since I am paying for this mortgage. This is my home. I want full ownership. I hope you can help me. I am running out of options.

The home does not belong to Ocwen. There is a lien on the home by the lender for the amount of the mortgage that was originally placed there at the time of the loan. There are very specific steps the mortgage servicer has to go through to foreclose on the mortgage. There are also special protections in the law for the repayment of the mortgage by a spouse when the borrower has passed away. This is the whole concept of probate.

Naturally the spouse has to continue to pay the mortgage on time each and every month.

In no case can a servicer come in and foreclose because they don't like what the poster has stated online. There may be other remedies for the mortgage company if the online postings are not true, but foreclosure is not an option if the mortgage payment is current.

To the original author:  contact your probate attorney and get accurate information regarding your specific ownership position and the status of the loan. Don't rely on answers from strangers online.

 Your isue is that if they put you on that mortgage then it MAY be called due because of your previous history. unfotunatly THIS statement is FALSE!!.....

This is my home. I want full ownership

No it IS NOT yours. Once you put a mortgage on it, it became the property of whichever group GAVE YOU THE MONEY. If you STILL have that previous issue, then it makes sense that they wont put you on the loan, because then ANYTHING that is put up for collateral AND has your name attached to it, will be confiscated and sold to pay the previous debt. While frustrating, you have to understand that ALL of your options available to you were all during your husbands LIFE. After his death, well a lot less options.

You may have to accept that you wont be able to keep the house. It IS collateral on the loan. Now that your husband is dead, they CAN call the loan due at ANYTIME and you wont have a leg to stand on. So if I were YOU, I would be ASKING THEM what I could do. If they call the loan due, youre out on the street. Whats MORE upsetting is the fact that instead of spending your energy online researching a solution, you feel its PERFECTLY alright to slander them online. YOURE making them out to be monsters and THEY ARE WORKING WITH YOU!!! So I would HOPE AGAIN that they dont find THIS post because im 100% sure THEY KNOW WHO YOU ARE!!! If I was a bank president and I saw this post from a customer I was trying to work with, well I would just call the loan due , AS IS THEIR LEGAL RIGHT, and I would let you swing for your spite and venom.

What YOU are forgetting and should ALWAYS keep in mind is this......THEY DO NOT HAVE TO WORK WITH YOU AT ALL!!!!!!!! So try and play nice or you will get your house snatched out from under you due SOLELY to your inability to control what you post online. Food for thought.

You are confusing two issues right now, the ownership part of your home has nothing to do with the mortgage part of your home. Are you on the deed? You can check that by pulling up the public records. The deed shows ownership, not the mortgage.

Since your husband passed away you have certain protections available to you through your state's statutes. The probate attorney you worked with can explain the entire process by which you are protected as long as you make the payments on time each month.  You are in much better shape to remain on the deed and not on the mortgage. If your probate attorney can't or won't explain it to you contact a real estate attorney to explain it to you. Also research under your state's statutes regarding probate law and home mortgage so you know what questions to ask your probate attorney.
