Fairbanks assumed my defaulted loan from Olympus Servicing in October, 2002. I defaulted on my loan due to an unpaid extended maternity leave beyond my control. After returning to work fulltime in July, Olympus Serving had initiated the process of foreclosure.

I didn't have money and Olympus Service Representatives attempted to force me to borrow and pay monies not easily obtained. They were often rude and insensitive. When I finally sent a payment, it was returned because it was in the form of a personal check and short of what they wanted. The Service Representative told me not to send anymore money unless it was all of what I owed. Then sent me a letter telling me they would make it difficult to buy property in the future due to judgement s and wage garnishments.

Olympus Servicing schdeduled a foreclosure date for October 18 then sent me a letter September 13 saying they had sold the loan to Fairbanks and not to contact them until after October 3. I contacted Fairbanks on the 1st but had to wait until paper work was downloaded. When I finally reached representatives from Fairbanks, they verbally agreed that they were glad to obtain my loan and they were going to stop the foreclosure since they would be offering me a forebearance agreement to bring my loan to date.

Was I deceived. They masterminded a plot to get my mind off foreclosure by offering me verbal promises they had no intentions of delivering. I found out on Oct 29th that they had in fact foreclosed on Oct 25, the day after my conversation with Chris Chipman as he made plans to overnight the forebearance agreement. In my last conversation with Chris, he informed me they had sold my house and that he couldn't help me anymore because he had left me a message the day before the sale with information they were going to proceed with a foreclosure. This is all a lie.

They've since filed papers with the court to issue a judgement against me and my family. They said I refuse to leave the property they've foreclosed on. They are lying. They have not talked to me and I'm not going to abandon the property without proper notification from the authorities. This has been especially stressful me and my family. I am a single mom with small children.

We received notice that our home was going to be foreclosed on in June from Olympus. Then Fairbanks assumed the loan. We were suppose to have a forebearance agreement worked out also. But when I received the agreement and took it to my attorney, she said do not sign this. I told Fairbanks that I was not going to sign this agreement on the advise of my attorney, and their comment was, "If I knew that there was an attorney involved I would have sent you some different paperwork." Also, check the paperwork that you received from the courts. On the front it should say who is foreclosing. If it says anyone other than Fairbanks, contact an attorney immediately. My paperwork showed that our loan originator was doing the foreclosure and they do not own the loan, Fairbanks does.
