One Percent Realty, USA in Austin, TX provides horrible customer service. From the CEO down to the realtor, they provide terrible customer service, if any. I signed an agreement to list our home for sale on/about 1 Jan 07. The Realtor, Donna Montgomery, appeared to be excited about assisting us in selling our home. Once Donna Montgomery collected the $500.00 check, we didn't see her again. Her employment with One Percent Realty was verified. On/about 27 Feb 07, we notified her we wanted to terminate our listing with her and One Percent Realty. She said we would forfeit the $500.00 initial payment and I asked "Is that it?" and she replied "yes."

Well, upon receiving the termination of listing agreement two days later, she added additional termination conditions that she did not mention before. The only condition was the forfeit of the $500.00. I informed her boss, Charles Galati and he's no better. He's been telling us that he would assist us in getting this termination completed for the previous three weeks and every couple of days, he has a different excuse as to why he hasn't been able to complete it. He deliberately lied and said he needed a second signature and that person was out of town for a week; he said he didn't send us information because we didn't have access to a fax (when he could have scanned the document and e-mailed it); he doesn't return telephone calls; he hardly responds to e-mails; and the list goes on.

I notified the CEO, Steve Malachowski via telephone on/about 2 Apr 07. Today is 6 Apr 07 and he hasn't even responded. The point is this company retrieves your money and WILL forget about you. If you do not live within close proximity of them, forget it. Even if you are close to them, pray that you are not out of their way because they do not believe in excellent customer service. Let me assure you that you from the moment I spoke with you I had your listing taken temporarily off the market so that I could gather all the necessary information I needed in order to accommodate your request. In addition I left you a message on your phone.

As I mentioned over the phone with you when we had first spoke, their were certain procedural things that needed to be done including, but not limited to understanding form Donna Montgomery the extent of her performance in accordance with the listing agreement you signed. Then determining what is fair on both sides of the equation, and then ultimately obtaining approval for your request.

According to Donna's 4 page letter I received. She stated she had over 49 emails with you since you listed your property.

Needless to say I feel compelled to honor your request which was why I had emailed you earlier to sign the termination of listing and that you would be free to sell your home to whomever you wish. Unfortunately I had no fax number for you otherwise I could amend this myself and fax it to you. So, if you like under Section D 3 which states who the fees under Section D2 would be responsible for paying to, you can simply cross through item A, were it states ?Anyone? and initial and under Section B write anyone who has made an offer prior to March 1, 2008, which was the date of the Termination Agreement.

If that is acceptable to you, I am more than happy to sign the agreement and fax it back to you at your designated fax number.

No Mr. Galati, this is NOT a conditional termination. There are to be no restrictions to what we choose to do with our property in the future. I tell you what, I'll will expeditiously inform my attorney that Donna and I had a verbal agreement that we would only forfeit the $500.00 (and that was it) and since I had her on speakerphone, I have a witness to her statement. I'm not playing this game with you or one percent realty. If this was your decision, it was unnecessary to lead me to believe you required a signature from someone else two weeks ago just to terminate this agreement and also mislead me last Friday when you said you would have the termination agreement ready for me on Monday. The public, home builders, the better business bureau and the media will definitely hear about this with your name and Donna's name attached. In fact, I'll ensure Steve Malachowski is aware of this as well.

You always seem to come up with excuses about why you were unable to get something done. How about finding one way or one reason to accomplish one simple task. I'm also out of town and in fact, out of the country but I'm continuing to close the loop on this issue so you being out of town, probably between Houston and Austin has absolutely no bearing on whether or not you can get someone to send me an unconditional termniation agreement.

I'm actually deployed in defense of the constitution of United States and I'm sorry a person in your position did not feel I was important enough to merit a little more professionalism by extending me a little more courtesy than you did. I help defend the very ground you walk on everyday and this is how you have decided to thank me. Well thank you for your time and for the elementary type behavior you displayed. All you have done over the past two-plus weeks is waste my time and accomplish absolutely nothing. I sincerely hope the next customer you come across is treated in a more professional manner than I was. Make it a great day.

What I would recommend you do is sign the termination and leave it with your wife. Your listing is on hold, so no one will be showing your property unless they've already seen it and you and your wife approve. If an offer comes in the next week we can address that if it happens. By next week we should have a fully terminated listing and be able to remove the sign and lockbox.

I have had the pleaure of working with Charles Galti for 8 years now and have found him to be more than willing to work with customers and go above and be yond to satisfy a consumer. In the emails I read he responded to them in the same day some times two times in one day or the very next day. Mr. Galati's position requires him to handle numerous transactions every day and is a very busy man but never too busy for the consumer. That being said I am a Mortgage Banker and there are several policies and procedures that, by law, we are required to abide by. It appears to me that the man in question hired a realtor and then found a buyer on his own and tried to side step paying his realtor her fee, which happens every day which is why there are procedures set up by law to protect not only the seller but the agent. Mr. Galati is a highly sought after individual and does travel for work often leaving him out of the office for days on end. With out knowing the full extent of the process I believe it is very unfair to try to tarnish such a great profesionals name. I have great faith in Mr. Galati and 1% Realty and customer service is thier number one goal. They send out comment cars to all consumers to find out if the realtor has kept in touch and given great customer service. Last I checked they were in the high 90's which in this declining market is a very reputable percent. They are growing larger by the day which is proof in and of itself that they have great customer service and repeat business. Please take the time to know the real estate laws in Texas before you assume that you have been done wrong or comment in a negative way about something you know little about, put yourself in his place and think about how you would feel if this happened to you and you had no idea in order to state your case. Trial by jury or vigilanty? Someone who really knows,

In all fairness to all the parties being mentioned here, it is only right that anyone who reads this complaint understands that with respect to real estate documents, everything, including terminations must be in writing and signed. Anyone can clearly see that Eric ignored my requests for a fax number in order to have the proper documents signed. In addition, Eric was returned his $500, immediately upon signing the necessary paperwork. We regret that this matter went on for as long as it did. However, due to confidentially, we cannot comment on other details related to this client. Our company prides itself on providing the best service possible. We have a 92% client satisfaction rate which we feel is critical to maintain such a high standard of service. Communication is necessary, and although emails are a form of communication, they are not enough to conduct real estate in of itself.

All I can say is you should have checked this guy out before you signed the line. Is he even a licensed real estate broker or even a real estate agent? You need to report him to the Texas Board of Realtors. They will yank his license in a heartbeat if he has done anything other than the borderline shady frauds, cons and rip-offs that Austin ,Texas is becoming famous for! And...you get what you pay for. Austin,TX is full of crooks. Too many for me. Why don't you contact the Austin American Statesman and tell them about it. I don[t recall him advertising with them. They advertised on KLBJ-AM and they advertised in the Austin Chronicle, I think. I think that News 8 would also be interested that they tried to rip off a soldier while he was on active duty! I DID AS LITTLE BUSINESS IN AUSTIN AS I CAN WHEN I LIVED THERE! And WILLIAMSON COUNTY IS JUST AS BAD!
