I have pasted my correspondence with Mr. Nyamunga my brothers Roy Kanai's Lawyer. Since he accused me of posting misinformation online it is only right to get the records straight.
First of all I have no comment on the Postings online but it is unfair for someone to mention me without cause.
Eugene Nyamunga has represented my brother even though he knows that may brother broke the law and unfairly collected my inherited share for over a decade. Mr. Nyamunga seems not to grasp the simple fact that you should not use someone's funds without permission, a right to get statements, know the exact amount collected and how it is or was used. Intact he once called me when I travelled to Kenya to ask me why I had disinherited my brother because I had authorized for the income from our rental property to be split equally amosits all siblings. That was very weird because I am the one who had been disinherited unfairly. If he can grasp that my brother is losing money why cannot he grasp I lost money? This reminds me of someone who is incompetent to practice law. Personally I would use an intelligent person who understands the mundane to even the complex. Roy had lied to us that he collected only Ksh40,000 in a good month only to realize later that he was truly collecting Ksh100,000.00 per month tax free. He claims that the funds were used to care for our sister who was under his care since our parents death. He must have feeding her caviar and clothing her with Prada for that amount.
Read bellow and make your own conclusions. By the way none of my requests were met by either my brother or his lawyer ............?
My full name is Xxxxxxx I need to know the percentage of fees being charged by your firm before I can give the o-key to proceed on my part. I will also appoint my own lawyer due to the fact that I have not received any income from the rental property since our parents death. If you are representing my brother, before I accept any deals I want a signed document that I will be paid 1/4 of the proceeds generated in rental income since our mother's death. Roy also owes me $1000.00 which he signed an IOU, I want that paid back too. I also want proof of the amount paid by tenants as from the above stated period.

Mr. Nyamunga, I paid for the Letters Of Administration to my uncle, Mr. Kirundi. Advice your client Roy that I am requesting he pays me back including my other siblings that you seem to be representing. The total payment to my uncle was $1,000.00. I am also requesting that Roy shares the rent from the shop he keeps the rental income to himself. As you know Roy has withheld the income from the properties from me for over 10 years which is called theft. I told him I would forgive him what he owes me but in light of the current refusal of him to share income from the property that he collects and keeps to himself I have decided to reverse my earlier decision to forgive the amount he owes me. I told him to send us all the statements showing the payments he received after our mother's death and to share all the income from the properties which he decided not to. When I came to Kenya, I divided the rental income fairly even when I was advised to withhold his share. Mercy's share alone would have taken care of her every need to include her school fees and he did not need to take our share. He never sent me any statements after my repeated requests. He disinherited me for over a decade. On the other hand my other siblings authorized their share to go to him and supported his misdeeds hence are us liable us he is in paying me back what was taken from me by force.
If there is any sale that will take place he needs to accept to pay me back after the sale or before the sale. I tried to make amends in good faith. Please advise your client or clients that I will be collecting what is owed to me soon.
