Overstock often sells items without manufacturer warranty. Check the item description & receipt to see if that applies to your purchase.

I don't think even Best Buy or Circut City would replace the ipod 4 months later. I understand why you are upset. I would be too. Something that costs that much SHOULD last longer. I own two ipods and I bought one at Nebraska Furniture Mart and one at Best Buy. Both places told me I have 30 days to return the item. They offered me a one year warranty that costs extra so if anything breaks they would fix it. But they also told me the Apple does have it's own one year warranty that comes with it. The explained if I do not buy their warranty and anything goes wrong, I would have to send it to Apple to be fixed. I think this is what applies in you case. I'm sure the Apple warranty is still good, you just need to send it to them to get it fixed. If you search their website or the paperwork that cam with the ipod, I am sure you can find a customer service number or an address where to send it to. But I would try to call them first.
