I answered a blind ad on Craigslist for experienced home improvement
sales people.They would only accept phone calls. I called in and was
told to meet at this office
late in the day. The office was closed but I waited until the manager
came. After I asked several questions and the manager's apparent
acceptance of me, I asked to see the contract. He told me to come in
Monday and I would see it and also for some initial training.
Once
at the meeting, I learned from 4 others new recruits, I was the only
actual person with home improvement sales experience in regards to their
products. The manager made a comment about what was required of us
later that morning and that we would receive the contracts later on
Friday. In other words, I was to drive and attend their meetings at my expense
for 5 days, memorize their sales scripts fast under pressure and do
product presentations by their standards and then at their convenience I
would see my commission contract.
I left at the first lunch break. This is a 1099 Independent sales contractor position and not an employee I was told.
They need to look under the IRS
guidelines as to behavior control in what is a sales contractor and an
employee. I was also told I had to call in for a TO at each appointment
if I made no sale and the leads belonged to them.
I wonder if SS8 questionnaire forms were sent to the IRS
for determination status what would be the outcome. He also told me I
had to attend a weekly sales meeting at a different location at my time
and expense. Under law this is an employee status and not an independent
contractor, as well their contract he said was exclusive with non
compete clauses and I was not allowed to see beforehand.
Behavior
control means just that, you can't make contractors attend meetings,
call in for sales aid before you leave a home or discipline them if
their sales falter for example. If they want employees, then do the
legal thing and pay expenses, supply vehicles, hourly wages and
commissions, tax deductions, SSI, benefits, unemployment and the rest.
It's all about their profits...

Yes this is Kelly, Not some disgruntled employee of Paramount Builders. In the rebuttal Mike stated that Chad is the one who wrote the report and not some Kelly in Midlothian, Well there is a Kelly in Midlothian, My name is Kelly S--- and i was a customer of Paramount Builders and i did have all of the problems that i stated above, However Mike has completely fulfilled my dissatisfaction with giving us for compensation new entry doors and storm doors as well as new gutters. So i appreciate what Mike and Paramount did for us due to all of the trouble that we had but i can honestly say that i am now satisfied with what we put our money in to. Kelly

The fact is this. The person who posted the above report goes by the first name of Chad, not "Kelly" from Midlothian,VA. Chad is from Ashland,VA and was hired by Paramount Builders to work in the sales department. After refusing to go to appointments that were "too far away" in his opinion. We, as a company, made the decision to let him go. The following Friday, he shows up at our Central office looking for his paycheck. Chad signed a legal document when he was hired, stating that if he should leave Paramount, either by his choice or ours, his final paycheck would be mailed to him after all of his jobs sold (2), were completed, and installed. When reminded of this, he verbally theatened to "murder the VP, hunt down his family, and burn down his home." WE IMMEDIATELY TOOK ACTION AGAINST HIM. This person is shown to have an extensive criminal history. Upon investigation, this IS NOT THE FIRST TIME he has done this to an ex-employer (of which he has many). Moving forward, Chad has launched an internet smear campaign against us by totally fabricating these stories on the internet. He can be found on craigslist doing the exact same thing. In fact, the "STORY", you just read above, is posted on another website who provided the user's IP address and guess what........it was Chad's. Folks, it's a shame that in today's world, with all that is going on, people must dwell so heavily on their hatred towards others and at the same time victimize them. Rest assured, if you hire Paramount Builders, we will do whatever it takes to "satisfy you 100%, PERIOD." Thank You for your time.

Update on problems. After our window was installed finally, i was standing at our back screened doors and felt my hair moving. Come to find out the whole door was installed incorrectly and there was 3 gaps with rushes of air coming into my house which increased our electric bill. I called once again to complain and they said they would send out someone to look everything over with a fine toothed comb. He went to open up one of the NEW windows and a peice broke off. Yet another problem arises. When he installed the sliding doors he just shook his head in disgust at how terrible the contractor did on installation and had to call Paramount to re-order 2 new sliding doors. Once Mel (the good contractor) came out to install everything correctly he found that they didn't do anything right previously and he took care of all my problems very diligently and correctly and thank GOD Paramount has one good employee working for them. We are still waiting to hear what Mike Finley has to offer us for a compensation for the 6 months of grief we have encountered.
