Patrick Gilmartin DBA ERM Partners Defaulted on a signed contract, whicht cost me two months of pay and a partnership buy-in fee while trying to provide for a wife and small child in a recession Burlingame, California
Last Summer, I was laid off from a large management consulting firm due to the recession. A short time thereafter, I struck up a conversation with a person at a local restaurant by the name of Patrick Gilmartin. Gilmartin was touting his new software-as-a-service (SAAS) Internet start-up by the name of ERM Partners.
Being knowledgable in SAAS and other technical 'geek speak', Gilmartin had the perfect pitch to get me interested in his firm. After several discussions over the next week, I decided to become a partner of his firm. We drew up a formal contract and got it signed.
Gilmartin asked me for an up front buy-in partnership fee of $2,000, which I negotiated to $500 due to my limited funds. We also agreed that he would pay me $8,500 month for my work performed that was clearly stated in the contract.
After a month, Gilmartin started making excuses on why he couldn't pay me for my first month's work. After a week or so, I knew somehting was up and told him I couldn't work further until he paid me. Well, he never did.
I took Gilmartin to Small Claims Court and easily won a judgment for $7,500 (max in SSC) but that was only the beginning. He's been ducking me ever since to the point where I cannot find him to be served and no one knows where he is.
I find out later that he has done this to other people over the years and he has serval judgments against him. His family also considers him a deadbeat and are ashamed of his actions.
I'm a hard working individual who believes there is a moral code to work that should be followed. That means fulfilling obligations set fort in a formal, signed, official contract. I'm the sole provider for my wife and two year-old son in the expensive SF Bay Area. This has caused my family stress in a difficult enough period with dealing with the worst recession sinve The Great Depression.
I'm going to continue to fight for my judgment, not mattter if it takes me 2, 5 or 10 years. For me, it's the principal of the matter and Gilmartin must be stopped.

I know where this guy is, he recently ripped me off, thank goodness it was only for $100 but it was my last. He recently moved to my city with a new girlfriend.

I had a similar issue with Patrick Gilmartin, and i won a case and go to http://ioubid.com and sold my case for 3400$ some Attorney bough this case and i am very happy, not to deal with that guy anymore..
