i went through a similar situation where an employer was going to withhold my paycheck and i was told by my attorney it is 100% illegal for an employer to withhold a paycheck for any reason, even if you owe them money. also the employer will be made to pay any attorney fees you incur to get your paycheck plus interest for every day that has passed since the day you were supposed to recieve your check so all you have to do is take them to court at their expense, of course if you still work there you don't want to do that

Thank you for your comments. Yes there is an appropriate time to pick up our checks and the general manager has discussed this with me. The time is set between 1pm and 3pm. We are not allowed to pick up before opening hrs., even though there are employees there that are qualified to open the safe, nor after 9pm because of the safe being time locked. Now, I work a second job and I am at that other place of employment until I go to pick up my children from school. That is the only time I have available to pick up my paycheck. We are a small town and we do have our busy times of the days and 3:30-4pm is not one of them. Also the Fair Act Law of the state of Iowa states that it is illegal for a business or General Manager to refuse an employess paycheck when it is requested. Also the day the paychecks are available for pick up is the day that we are allowed to retrieve them and should be able to do so without these unexcusable refusals. Not sure what else to say right now about this matter, except that I am still upset by it and that my place of employment IS making illegal actions based on the Fair Act Law of Iowa. I have contacted and spoke to a representative from the Iowa Civil Rights Commission in Des Moines, IA, and that representative gave me the concrete information on the Civil Act Law. But thank you to those of you that did rebuttal. I do appreciate it and your thoughts have been honest. -Unhappyemployee

Just because the checks have been cut do not mean that you can pick them up immediately. Most restaurants only allow employees to pick up their check after a specific time. This allows them to get through the lunch and dinner rushes without having to go open the safe for each and every person that comes lollygaggling in for their check. Restaurants normally go over the procedure for picking up checks during the orientation period. May I suggest you call the general manager to review this procedure so that you are on the same page with the company.

I work for an NPC Pizza Hut in Iowa, and it is NOT ok for them to not give you your paycheck upon request. If this complaint is for real, then all you should have to do is contact your Area General Manager. He or she will take care of the situation. We actaully have a pretty good group of AGM's in Iowa, and I am a little surprised to hear something like this comming from one of the Iowa stores. I find it VERY hard to believe that an employee can ask any of her Managers for a paycheck and be refused, especially at 3:30 in the afternoon. This report is either bogus or a very easy to fix, non-issue.
