The reason for this letter is to inform you that Premier Car Co. located at 4513 W. Glendale Ave. Glendale, AZ 85301, is in the habit of taking advantage of the Mentally Ill. Their unethical business practices are designed to debunk and defraud.



On Wednesday January 6, 2010, after I was assured certain concerns regarding the condition of the vehicle were addressed, after signing over a $1000.00 trade-in, and after providing a $1000.00 cash down payment, I financed a vehicle at Premier Car Co. through Credit Acceptance Corp. 25505 West Twelve Mile Rd. Southfield, MI 48034. The financing included two addendums: a used vehicle service contract and GAP policy. The transaction concluded and I left in the vehicle after 5pm that same evening. On my way home it became apparent that the concerns were not properly addressed. Upon further reading these same concerns were not covered under the vehicle service contract, nor any immediate breakdowns as defined in the service contract related to the previously mentioned unaddressed concerns. 



Within twenty-four hours I returned to Premier Car Co. On Thursday January 7, 2010, I spoke directly with the owner Darrell Hesher. I advised Darrell that the vehicle was not in a state of repair as assured by him and his partner Joe as a condition of my accepting the debt and vehicle. I also directed Darrell to the specific provisions and exclusions in the service contract pertaining to these deficiencies. I requested that the inutile service contract and GAP policy be removed. After being yelled and cussed at by Mr. Hesher, he showed me, by the use of his computer, how the financing without these two addendums would lower my monthly payment and length of contract, as well as his bottom line. I was then asked if the repairs [not covered under the service contract] could be repaired under another item that was covered, would I accept financing the additional $2300.00 (the combined additional costs of the service contract and GAP policy) 



With head reeling from the verbal abuse and the suggested claim fraud I said I would be in contact the next day. To protect from further abuses I returned the following day, Friday January 8, 2010, with my father. I returned armed with further proof from an independent source, that the vehicle was not repaired as erroneously affirmed. Mr. Hesher advised me to leave the vehicle and that some repairs would be completed while others would only be reviewed.  Further, Mr. Hesher said I would need to cancel both service contract and GAP policy myself, but shouldnt without waiting thirty days (grace period?). I left without the vehicle. Upon calling Wynns (service contract) they stated they had nothing in their system, and I need to speak with the car dealer, Premier. Premier says I need contact Wynns. Also Mr. Hesher now stated that canceling the service contract will not lower my payments, I must still finance the additional $1800.00. It will just come off the back end. According to Mr. Hesher, what he showed me on the computer was how much lower my payments would be if we didnt include the service contract in the first place. 



 I was contacted Saturday January 9, 2010 by the finance company verification department. They verified name, address, and trade-in. They can not help me. The representative, Eli Smart, said they have a signed binding contract. I must wait until Monday January 11, 2010 and speak with Customer Service. I didnt wait and called Customer Service that same day. This time nothing was in the finance companys system and nothing can be done until it is in their system and I must speak with the Verification Department. Verification said once entered the contract is executed, call Customer Service. Customer Service says nothings in their system, I must speak with Verification. I was told to contact the car dealer Premier again, who suggested I wait thirty days. Finally the finance company customer service representative took name and number and supposedly a supervisor would call, Monday, after its in their system, executed, and there is nothing I can do about it. 



If I want the car I must accept it without pertinent repairs, financing the additional $1800.00 service contract and $500.00 Gap Policy. Cancelling both will not lower my monthly payments even though I was in immediate contact within twenty-four hours of the transaction.  



We returned, as directed by Mr. Hesher, Tuesday January 12, 2010, to pick up the vehicle. Surprisingly we were told all the repairs had been made to the vehicle of which I had financed last Wednesday (and I only drove for two days).  I was further astounded to be informed, Mr. Hesher, and/or partner, had been to the location of the trade-in vehicle and were now not happy with the amount they contracted with me for the trade-in. I was asked for more money, apparently to off-set the lost revenue from the cancellation of the two addendums. My father proposed I not cancel the two to placate the deal and we were asked to return the next day so Mr. Hesher could think it over. 



Wednesday January 13, 2010, my father and I returned for the vehicle with all expectation of leaving with said same vehicle. This time Mr. Hesher demanded we part ways and negate the deal. He wrote a check for my $1000.00 cash deposit, withholding the check while pushing a copy of the trade-in vehicle title upon which he had written never took possession of vehicle (no, he left it on 40th St. and East Danbury from January 6, 2010 and turned the key on the vehicle on January 11, 2010 by his own admission.) By this time I had become increasingly physically ill, my father laying hand on my shoulder for what little comfort he could provide. I could no longer participate in this deleterious charade. As I held out my hand for the check Mr. Hesher just pushed the copied title at me for the second time. I was denied the refund of my down payment until I signed the document under duress. On paper Premier Car Co. was in possession of the vehicle seven days. Mr. Heshers partner Joe made the comment You should get insurance on that vehicle with it sitting on the street like that 



On January 13, 2010 at 1:44 pm as we left Premier Car Co., I was informed by phone that my original car, the trade-in vehicle, the vehicle listed as trade-in on the finance contract filed and executed by Credit Acceptance Corp. as of January 6, 2010, verified as traded in by Credit Acceptance on January 9, 2010, of which I just received the title back from Premier, was no longer at the location Premier left the vehicle. It was no longer at that location as of early morning January 13, 2010. I immediately called Premier and asked where the vehicle was. Mr. Heshers response was I have a document that reads we never took possession of the vehicle and disconnected. 



I await callback from the Phoenix Police Department. 



Such an experience devoid of basic morality and full of dishonest unethical business practices is disruptive to the laypersons life to say the least, for the Mentally Ill direful. The challenges of my disability have manifested and my academic studies have suffered. My focus of Recovery turns from higher education to managing symptoms. This shift is of great concern to self and family.  Premier Car Co. knew I was disabled from the very beginning of negotiations. They verified my SSDI for proof of income.
