I signed a contract with Pro Fitness for 2 sessions/month with a trainer at my fitness club. A few months later, they were offering specials, and I upgraded to 3 sessions/month for the same price.  I had to pay an additional fee to "process" the new contract, and was told something to the effect that they would send in the paperwork to cancel the old contract, or that the new contract replaced the old contract. They assured me of this.



Several months passed, and one day my spouse decided, for whatever reason, to look at our on-line bank statement by payment amount, rather than by the usual date. That's when he discovered we were being billed twice/month by Pro Fitness, for the same amount.  By this time we had been double billed for about 10 months. It wasn't apparent before because the amount was the same, it showed up on dates 2 weeks apart, and we weren't looking for anything in particular.



I promptly called their accounting branch and explained the situation. I ended up calling 4 different times, each time being assured that someone would call back in 2 days. I always had to call them back after several days. They assured me the duplicate billing was stopped, but I'd have to contact Pro Fitness for a refund. I contacted Pro Fitness, which asked for my bank records to show the double billing. They then informed me that "there was nothing they could do as I never sent in a cancellation letter for the first contract." They were unimpressed that their people on the ground told me they took care of it automatically when I signed the new contract.



By the way, the duplicate charges came out to $600. I am going to fight this any way I can to get a refund, and to get their reputation out there. And, the additional billing was not stopped after the first time I spoke to them, resulting in an extra $60 being charged (so far).

I spoke with a former employee of Pro Fitness, who told me that what I describe is endemic in Pro Fitness, "it's the way they do business". They lure you in to a contract, then do things like double bill, take cash payments and not report them, etc.  I will continue to try to gather information, to see if there is standing for a class action law suit. I am no longer angry; my motivation is that this company (and many others) are getting away with, at the very least, highly unethical/misleading behavior, and should not be allowed to keep getting away with it.
