Thank you for sharing this information Sharon, I'm going through the same thing through Huntington National Bank. The lady in the lost litigation department sent me a letter saying that I met all the required documentation, then called and said that she needed more information. Then I went in the hospital for 11 days and they said that I had to complete a second packet (which I did) and they came back and offered me a modification of a lower payment for 30 more years, with a balloon loan at the end for $36,000, thus making it impossible for me to ever own the house. Not to mention, that the house is only valued at around $40,000.
I went to see a private attorney, and they claim that this bank and their sneaky underhanded behavior since the beginning is in violation of R.E.S.P.A. Reg. X. I have two weeks and my house is going to sherriff sale, because while I thought they were working with me, they were clearly moving forward with the foreclosure. My loan is an FHA, and they said that they have to meet their guidelines. I'm having a hard time wrapping my head around the whole situation, due to how fast they've been moving during my hard times. I thought that's why FHA loans have to pay a PMI. I just don't get it.
In addition, in 2010, I had a loan modification and the lost litigation lady at that time literally bullied me into agreeing to terms that I would never have agreed to, if it wasn't Christmas time and at that time I had custody of my two minor nieces and I feared for our shelter. The whole reason that I took the girls in, was because they were homeless to begin with. After reading the docket today, I went back to the 2010 docket for the first time and seen that it was the same firm at that time. I made 6 months of payments and the representitive at that time said that it was for Attorney fees, and then after I pay 6 months on time it will start going toward my house payment. I'm totally confused about the whole matter. And like you and your husband, I too, have nowhere to go and I'm disabled. I don't know what to do anymore. I actually worked 3 jobs in 2010 just to keep the house and now I CAN'T work.
