This place is a trucking company who requires thier drivers to sign a contract calling them a independant contractor.

I quit driving for them about 8 months ago with the plan of starting my own small construction company, this idea has fallen apart and I decided to go back to driving.

Mean while I did some research on tax issues doing with independant contractors and such I have found out that it is against the law to list someone such as myself as an independant contrator.

According to the info that I have found a driver int his situation would have to either own or lease the truck and have the sole say in who drives it and rides in it, also this driver would also have the right to hire and fire just as if it were actually the drivers own company.

This is not how it works with Rich-Co though. They tell you how many trips you will make at a time they tell you who your co-driver will be, they do all the hiring and firing. It doesnt matter if they hire someone to put in the truck with you and they rob you blind and leave you out along the road with no money or what ever they have the last say in rather or no the person gets fired or not.

They also require the drivers to either carry a workmans comp policy on them selves or give them a copy of a workmans comp exclusion form so that they have it on file to protect themselves.

In my case they even went to the extent to tell me that should the friend of the court contact them about keeping my child support out of my pay check each week that I would need to find another job because they would not have any part of it.

I know all this stuff that they have done and are still doing is against the law.

The problem is that I do not know what I can do about it or how to do it.

I still owe the IRS a bunch of money because of the way that they do things with income taxes, but so far I have not been able to get any where with the IRS and the phone number that I have for them.

Tim from Mesick is just another dad called by the state and the courts a DEAD BEAT DAD. Tim from Mesick moves from job to job and when the friend of the court catches up with him just quits and moves on. Rich-Co Transportation does not like to work with dead beat dads that owe thousands in back child support because they usually have warrants on them also. When they get stopped in the truck they get arrested and our truck is left along side the road. These dead beats never tell you they owe back child support when they contract with you and the court will send you not a request but a court order to deduct usually most of their money for supporting their own kids. This is done only because they did not pay to take care of their own children. If a company fails to deduct the money the court will order THE COMPANY TO PAY ALL the dead beat dads like Tim from Mesick back child support.If we do deduct the money the dead beat like Tim will quit and move to the next job until the court catches up with them again. At Rich-Co we perfer if people like Tim from Mesick that wont even support their own children we dont want you dont come here.why should we have to file legal papers deduct money send it to the court and do the job the dead beat wont do. Let them go to jail. We have even had to pay up hundreds in child support bond money to get a driver released so we could get our truck back or a load of frozen produce delivered on time. In the past we have had to send thousands of dollars to a dead beat dad stopped at a weigh station and arrested for back child support in order to get our truck and load delivered. Many times the dead beat will then quit driving sticking us with a huge debt. Yes we would rather dead beat dads like Tim from Mesick would just go on to the next trucking company and then complain because we dont want to get ripped off by them. They rip off their own flesh and blood is there any doubt what they will do to any one else. Bill Richards Rich-Co Transportation

I have done some more investigating and found plenty of email addresses and phone numbers along with websites with alot of imformation pertaining to this problem with my ex-employer. I have filed complaints with FMCSA, the IRS, the USDOT and several other places haveing controll or this kind of thing. Now I can only hope that Rich-Co will learn their leason from all of this and that I can reach anyone who thinks about going to drive for them before they make the same mistake that I have. Still any input is more than welcome.
