In October 2003 I agreed to complete a re-finance loan signing with a Santa Barbara county borrower in Santa Barbara, California on behalf of Elite's client, Cleartract Title Agency in Syracuse, New York. Signing was performed in a workmanlike manner free of any glitches, and delivered on time for successful closing, for which I was to be paid $75.

I've invoiced Elite Signing Service, phoned, left messages for Rich, emailed Rich, and in three months, not one response. I was always told he was out of the office, that he would call me back, no the AP person is out to lunch, call back. I would call back, no answer or the AP person went home already. In short, I consistently received the royal run around.

Recently he went public and said he would take calls from people whom he owed money to, and I received an email that my check had been mailed on January 20, 2004. When I still had not received my payment by the end of January, I once more emailed Elite Signings. I received an email back that they had sent my check to another Cheryl Elliot in San Diego. However, that is not me~I don't live in San Diego, I live in Santa Barbara.

Now I see on several of the professional signing agent boards I subscribe to that Rich is representing himself as the ESS company trying to get notaries to accept assignments from him, and we're all hip to his scheme. No one will work for him unless he pays all delinquent fees up front as well as the current signing accommodation.

Elite Signing Services Inc. contracts Notaries Public throughout the United States to complete refinance loan document signings and does not pay agreed upon fees to their notaries. It would appear to me to minimally be a violation of banking/notary public law within the state they conduct business, a violation of banking law to the title/escrow company which hired them if there were no intention of paying the fee while charging the borrower for the fee. Additionally, there is a possibility of violation of federal laws regarding the interstate use of phones/faxes to contract banking business.

I am proceeding to file a judgment against Elite Signings and Mr. Barry and will hire a judgment collector in Cary, IL to stand at Mr. Barry's cash register for soonest payment since he lacks the integrity to pay me after numerous requests.
