My family and I moved into Ridgegate in Sept. 1 2001. Two days after we moved in our tires on our vehicle's tires were all slashed. We filed a police report and notified the office and thir response was "not our problem".

The next problem was approx. two months later we had two gentlemen knock on our door, one wearing an gun on his side asking the previous renter. After a few minutes of standing there he left and again we reported this to the office and again their response was "not our problem".

Five months into our lease not one thing reported to maintance was fixed. We reported things like our sliding door not locking, our peep hole was painted over, our bathroom faucets were leaking, our dinning room like had no cover. My husband had to fix our sliding door himself, it took the office 8 months to fix the things listed above.

In febuary of 2002 I recived death threats in the early hours of the morning, this person was saying they knew where I lived, when my husband worked, and how many kids I had. We made a police reprot again and they suggested we ask the apartments to help us move while they investigated. I left to familys house and my husband fought for 1 week for them to even consider the thought. They came to the conclusion that for 2400 dollars. We did not have nearly that amount of money and no payment arrangement could be made.

Our recent problem was we woke up to the air let out of our cars tires and gum smeared across our windsheild and again we reported it to the office and again asked for help with our lease, but this time they replied with we will take 1600 dollars if you move out before the first of the month which was only 3 days away. That was imposible so agin we were forced to live in this very hostile and unsafe envierment.

You seem to be the target of someone with a beef against the former tenant of your apartment. You are foolish to remain in this apartment for one more day. If you have suffered vandalism, death threats, and armed people showing up at your door looking for the previous tenant, it is not safe to remain. The Arizona Residential Landlord and Tenant Act (ARS 33-1301 et seq.) requires the landlord to supply a safe and habitable dwelling. Yours is not safe and the landlord has ignored all your previous verbal requests to remedy the problem with your apartment. True, they did not cause the problem but the law puts the burden on them to remedy the situation -- like hiring a security guard, for example. First, find another place to live and start moving out today! Then hand deliver to your landlord a signed letter that begins with "Pursuant to ARS 33-1361 you are hereby notified that five days after your receipt of this letter we will terminate the lease on apartment #____ due to the fact that our continued occupancy endangers our lives and property and the fact that you have repeatedly refused to correct this situation." Then list in detail what has happened to you and your cars since you have lived there. Include the dates, police report numbers, and the response from the landlord each time you have reported these incidents. Finish by stating that "The above incidents constitute a breach of ARS 33-1324(A)(2) as the apartment is not habitable." It is important that you put this in writing. Keep a copy for yourself. Your landlord is not likely to refund your deposit and may even file a lawsuit to recover damages. Don't let that stop you. Your life and safety are more important. Besides, no judge will force you to pay rent on an apartment where gun-toting thugs are showing up at your door. I strongly suggest you find a lawyer but quit screwing around with this dumb-a*s landlord and get out for your safety.
