I filed a complaint with the Huntsville, AL police department on 10/19/04. The officer who took the report phoned me on 10/21/04 to let me know that he reached the Lindseys who gave him lots of excuses. They told him that they were out of town and while they were gone their computer was unplugged, and that they didn't know of any complaint until the officer contacted them. They also contraindicted themselves by saying that upon their return they discovered that the tile I requested was on backorder and the mural never got made or shipped. The officer told us that the Lindseys claimed that they tried to contact us by phone, which was not true (we have caller ID and an answering machine), so we can prove this isn't so. The police officer told them that they had until Monday, October 25, 2004 to get the tile mural to us. The tile mural was received via USPS overnight shipping on Saturday, October 23rd. In the package was a packing slip that stated that the mural took this long because "our computer was down and we could not retrieve your address information", which was another lie. Anyway, I'm just glad to say that with the help of the Huntsville Police Department, we got our merchandise and can mark this complaint as resolved. However, I would not recommend this company to anyone.

I still have not been able to get in contact with Robert Lindsey after further attempting to phone him on 10/9/04 at 3:14PM, 4:25PM & 9:08PM (all no answers), 10/10/04 at 9:11-9:17PM (line busy) and 9:18PM (no answer), 10/11/04PM (no answer), and 10/12/04 at 5:50PM (no answer). So in the meantime I've filed a fraud complaint with the Federal Trade Commission and have been given a reference number with them. Ten days after filing a fraud complaint with Paypal, they responded by stating the following, "We have determined that the seller is at fault in this matter, but regret to inform you that we were unable to recover andy funds from the seller's account..." they also said, "Please know that we will make our best effort to recover the funds in question if they become available in the seller's account in the future..." This really dashes my opinion of Paypal. On 10/17/04, I contacted the the company that hosts Mr. Lindsey's websites, www.tilemurals.net and www.tileportaits.com and have requested that they be removed due to fraudulent use of their web space and am awaiting a response from them. On 10/18/04, I contacted the Huntsville, Alabama police department, who verified Robert Lindsey's address and phone number. I've filed a Theft By Deception police report with them (Case # 200424189). If I don't receive a refund from Mr. Lindsey by Friday of this week, then I will also be contacting the Huntsville newspaper and television stations for their assistance.

As of October 10, 2004...I still have not received any reponse from Mr. Lindsey even though I've sent him a copy of my complaints to Ripoffreport.com, Paypal and the Alabama Attorney General. I've continued attempting to telephone this person on 10/7/04 at 5:15PM (no answer), 10/8 5:42PM (no answer), 10/9/04 12:25PM, 4:25PM and 9:08PM (no answer), 10/10PM 9:11-9:15PM (line busy), and 9:18PM (no answer). According to the telephone and address reverse search I did using www.whitepages.com, I verified that the telephone number and mailing address listed on Mr. Lindsey's online order form are registered to a Tammy Lindsey. If this guy is taking money and not bothering to send merchandise, it could be possible that he also isn't reporting this income to the IRS or Alabama...I may contact the Alabama Tax & Revenue Department and have them check him out!
