I was leasing a property through the agent Mark Ramus until I was the told that the owner wanted to serve me with the 30 Day Notice to vacate, which I received on January 2, 2015. Ultimately, this was because my daughters friend who pretended to be my daughter in order to gain access to the property. Although my daughter was at home with me at the time that this friend wrecklessly drove a car down the street and damage 2 houses, which they tried to say it was my fault and I ultimately moved.

Appoximately 33 days later I call them on March 3, 2015 they said they would put it in the mail and I received the letter March 7, 2015. Unfortunately, I did not receive my deposit but instead a rather lenghty invoice from a company called Express Home Maintenance, which I tried to contact at the Magic Jack number provided but no answer. I also contacted Rowan Real Estate and they said they would get back to me in 48 hours.

They did not get back to me so I mailed them a certified letter below:

RE: Security Deposit (133 Crooked Putter Dr.)

I am in receipt of your itemized written accounting and disposition of my security deposit that was received on 3-7-2015, which is not in the allowable 30 days. Nevertheless I am writing this letter as a dispute regarding my security deposit, which as I understand should be my initial response to your claim against my security deposit prior to submitting a complaint per the Nevada Real Estate Division.

As you should be well aware the Nevada law permits a non-refundable deposit only for cleaning and this was not included in my lease agreement, therefore you are not entitled to claim it as a deduction. Furthermore, the charges that you have listed are a result of deferred maintenance or normal wear and tear on the property and not actual damages and can’t be charged to my security deposit legally, which is an unscrupulous practice and an attempt to keep my deposit and as such I have included an itemized explanation for your review.

Also you listed a company they were responsible for the maintenance, which is called Express Home Maintenance that is not licensed to operate or registered at the address provided, which  is listed to Robert and Debra Fonseca but I was not able to contact them for their explanation of the charges at the magic jack number that was provided.

Finally this is an attempt to resolve this dispute I am expecting my deposit to be refunded with a deduction only for the invoice included which is for $150 for yard service as I was still a resident of the property and the difference of $1950 should be refunded. In closing it not my intention to escalate this matter further so I am hoping to receive an immediate response to my claim.

Conclusion:

I recived a call on Saturday from a representative of their company who told me the owner needs to meet with me and that none of the work was done and what I received in the mail was just an estimate. Of course that is even more confusing... Nevertheless, I would not waste my time meeting with them because this to me seems like unfair business practices and I am sure that I am not the first. However, I have so far filed a complaint with the BBB, Nevada Division of Real Estate and the Attorney General. I would appreciate any suggestions from anyone who might have that has experienced a similar situation.

I never confirmed this appointment that you’re are referring to and it appears your like-minded minds have reached the same conclusion when it pertains to my deposit but this is not a surprise as it is to your benefit you have redistributed my deposit again in a way that benefits your company which is pathetic and desperate.

An since you mentioned that Dee Dee who is employed by Rowan Real Estate also provides estimates to your company via her personal company Express Home Maintenance, let me bring to your atttention  this practice is unethical because it creates an opportunity for her to benefit from her inflated estimates as an employee.

Also, there are a lot of other charges that you are failing to address. Like the fact I received from the HOA that the violation was corrected but you still charged for the driveway not to mention the unreasonable cleaning deposits which were not required in my lease. Also the blinds were in need of replacement when I moved into the property. However as previously stated it is clear what your intention is this matter and it is clear that it will be necessary to escalate the matter further.

Finally, if there is ayone else who has experienced the same type of unfair business practices from Rowan Real Estate please feel free to contact me as there is power in numbers!!!!!!

Yet the true test will be when I talk to Mr. Haung who is the owner of the property to verify your claims which I suspect are in no way true or factual.

Mr. Rowan, Mark Ramus, Dee Dee Fonseca, Cathryn and I met Saturday at the agreed upon time of 9 am for the appointment agreed upon by you with Mr. Rowan on Tuesday the 24th of March.  We are sorry that you were unable to attend.

We did go over the security deposit transmittal dated the 3rd of March and did revise the charges. 

We found that you should not have been charged the full amount to replace the blinds but the agreed upon first $100 that should have been informed to our office to complete. 

We all found that the $130 for moving the washer and dryer back into the home should be lowered to $50.  The landscaping was originally done at $150 and the additional was to be done by Express Home Maintenance but it was decided that we would send the original landscaper out to do the job correctly and we will not be charging you the additional $100.

At the move out inspection it was noted that there were bleach marks on the loft upstairs, the carpet could not be fixed and the owner has had to replace it.  We have charged you the cost with a discount for depreciation. 

The window that was cracked also will have to be repaired I have included the estimate from Hy-Bar.

I am in receipt of your 2nd attempt to justify keeping my deposit, which again is fraudulent and you are now simply claiming to have done different work at the property. Therefore, I will be continue with my efforts to expose your unfair business practices that seem to be supported by the invoice from Express Home Maintenance that claims that no work was completed at this home. Additionally, I have reached out to the owner Joseph Haung who I am certain will be able to corroborate that Rowan Real Estate performed no maintenance at his home.

Also, Nevada Law requires the deposit be returned in 30 days not 33 nor does it support your claim that you initially sent me a estimate to follow up with actual billing, which is found at the Nevada Revised Annotated §§ 118A.240 to 118A.250.

Unfortunately, it is so sad that your organization has to resort to fraudulent activity in order to turn a profit so I would definitely urge anyone who considering leasing a property to not use this company. Additionally, if anyone is interested I would be more than happy to send you a copy of the 2 security deposit transmittals.

When a tenant moves out the work that is needed is estimated in so as to get the former tenant their security deposit refund out as quickly as possible.  If a dispute is recieved Mr. Rowan gets with all parties involved and goes over the bids and bills to see if there are any errors.  If there are then corrections are made and any refunds possible are returned to the tenant.

In your case I believe you have a meeting in two days at 9 am with Mr. Rowan and Mark Ramus to discuss the issues and recieve a corrected transmittal.  We hope to get this issue resolved quickly on that date.


Express Home Maintenance

I spoke with the owner of Express Home Maintenace and they have verified that none of the work that on the invoice that accompanied my Security Deposit Transmittal was completed and it was only provided to Rowan Real Estate as an estimate. However the invoice implies that the work was completed and I in fact owe them $594.49 and that payment was due within 10 days.
