On Oct 25th 2013 at 7:46 am I was traveling EB Broadway to Summit. I stopped my car at a 4 way stop sign and then proceded to pull into the intersection.  Ms. Her (Safeco insured) was traveling SB Summit to Broadway Av. The intersection is a 4-way stop but Ms Her (Safeco insured) failed to stop for her stop sign. She ran her stop sign and hit my car in the middle of the intersection.  I called the police to the scene . The police report states that evidence indicates that my vehicle was in the intersection ahead of her vehicle and that my car was indeed struck by her vehicle in such a location as to indicate Ms. Her (Safeco insured) having fault in the accident.

Citations were issued to Ms. Her. I reported the accident to her insurance co (Safeco) on  October 30th and provided a statement to them. Ms. Her was unresponsive to her insurance company , According to her agent and the company she refused to return her agents phone calls or respond to any of their inquiries. Safeco said they could not proceed on the claim until they could get her statement. Ms. Her drew the  length of the  matter out extensively which in turn resulted in extreme fees  for myself while waiting for Ms. Her to cooperate so Safeco could determine the claim and settle.

Ms. Her finally agreed to giving a statement to her insurance company on  December 17th. A  complaint has been filed and   a  violation issued to Safeco for their part in drawing this  claim out. However the main fault lies with Ms. Her as she would not cooperate with her insurance companys requests therefore drawing this out. Safeco denied  the claim on January 8th. As it states in the police report Ms. Her is at fault for the accident and therefore responsible for the cost of my car a 2002 Mitsubishi  Gallant valued at  $2625.00 and the  rental costs of  $1580.74 that resulted from her lack of cooperation with the  insurance company.

 Then you have to take HER to small claims court. With the evidence you have it should be a easy win. Whenever a insurance company doesnt make you whole after a accident the remaining amount owed is ALWAYS taken from the individual. You are NOT done with this. Go file today!!
