I had paid nearly two thousand dollars to have my mortgage loan modified. It all seemed too good to be true. Our monthly mortgage payment was over three thousand dollars, which was about what we made each month. The mortgage company would not work with us and a refinance was not going to happen. We were not behind with our payments, but knew we would be soon.

So we learned of this loan remodification company that offered a 100% 90 day money-back guarantee if the loan was not modified in three months. Simply put: nothing could go wrong, right?

But once the company got its money, it made contact with the mortgage company just once, and according to the mortgage company, that was it. Samaritan Financial Solutions, Inc. did nothing further, even when pressed by phone to do so, and my house slipped into foreclosure some seven months later.

I pressured the company to get at least the mortgage audit done so that perhaps there could be a modification with the mortgage company. Eventually, after much pressure and numerous calls, it did. But the audit was not legal. We had it analyzed by two lawyers who told us such.

And we had to get a lawyer because Samaritan Financial Solutions, Inc. was not going to continue the modification process. The company's owner does not want to give us our money back, and has said that they deserve the money for completing an audit, which of course, is not legal in a court of law. It was stated on their website when we retained their services that we could get our money back, but we didn't. And eventually it was promised that it would be sent out, but it wasn't.

Before jumping to conclusions and believing this is an isolated incident, I have two neighbors also in Mr. Diaz's program. One fell into forclosure and the other has hired a lawyer. My spouse knows of other victims. Samaritan Financial Solutions, Inc. is a company that takes money from victims and puts off its work for them as long as possible, even if it means letting them fall into forclosure.

From all our research and speaking with lawyers, we have learned that a true loan modification should be done by a lawyer or a modification company that has lawyers and will tell consumers who they are and how to reach them. If you fall into forclosure, find a lawyer who deals with loan modifications. Don't get scammed like we did. Your home is more important than that.

Just to state the facts for the record and not false information that Mr. Rich Diaz has been doing. 1) I April Heckrodt did not keep poor records as I had everything dated and timed exactly and stated what the conversation entailed with what was said and Mr. Rich Diaz has the originals of all the paper notes along with the computer emails of the notes. That is if Mr. Rich Diaz did not destroy them after I received confirmation from him that he got them. It was Mr. Rich Diaz who took poor notes and was way behind on his work and wanted me to lie for him and make excuses for his clients because he could not keep up. Well Rich I always say that the truth always comes out. The truth is Rich had several months to get a replacement and as a matter of fact it was I who got the replacement for him I will not state there name for there privacy but Rich knows who that person is. So for him to state that I left without him having a replacement is untrue and wrong because he already had his replacement when I left. I also stayed up till 2am in the morning to get all the files to him and over nighted the customer original paper files to him that next day the same day I gave him my resignation notice which was 12-02-08. I was not let go by Rich I left on my own because of him not getting the information that I needed to get to the customers lenders to get there modifications completed. Instead Rich put the majority of his customers into foreclosure including my own home because he neglected to get me the information. Instead he gave me every excuse in the world instead of the truth. You forget Rich that the clients have there email and paper trails as well and they would say differently about me. 2) As far as taking accountability for my actions I have done that Rich and I did take care of our clients as far as I could. I was the smart one by getting out from your scam and taking action by not sitting back and seeing all of Samaritan Financial's clients fall into foreclosure and lose there homes because you Rich refust to take blame and be accountable for your actions of not getting the loan modifications to the banks in time. My job with you Rich was to contact the clients banks and make sure that they had the information that they needed I did that. I then tried to get the missing information from you and that didnt happen because you kept giving me an excuse that you were working on it or would give me a time that I would have it and I wouldnt get it. I at least if I stated a time I would make sure that it would get done unlike yourself. 3) The fact is that Rich Diaz is to blame because he didnt get things done in a timely manner. I was not incompetent for the job instead I was over qualified for the job. Rich took on more than what he could chew. Instead of stopping and taking care of the clients he already had he kept on getting more new clients and putting more people into trouble and foreclosure. As far as the clients files being in good hands they were when I was taking care of them. The clients will back me up on that one and that Rich is to blame for the lack of communication and handling there modifications. Rich stated in his contract 90 days to complete however none of that ever happened. 4) Rich stiffed me of my 90 day refund of 1500.00 and only refunded me 200.00. I would hope that you would be a man of your word on your 90 day contract and refund me the remainder 1500.00 that is due to my husband and I. 5) The fact of your mortgage audit Rich I didnt state that it was illegal. I stated that the mortgage audit that you completed on our file was not legal as it stated some false information that you had put and it was not notorized stamped and sealed by whom did it and sent certified. I found this out by a lawyer who checked it out. After I stated that to you, you then proceeded with sending me a signed copy of the mortgage audit but forgot to have it notorized by a notary republic. 6) Just to clarify to Rich I April Heckrodt have nothing to hide as I have been in contact with both the IRS and the Social Security Disability office since 2008. They both stated that I am not in the wrong that it is Rich as he didnt provide me my w-2 that was to be sent out by 1-31-09 by law and now he is in violation and being investigated. I did state to you Rich that I was concerned with it affecting my Social Security and you stated that you could pay my husband instead. After speaking with Social Security they stated I was under the income guidelines and was fine and I had requested you to send me a w-9 form and I never received it from you. Nor did I receive my w-2 form. My intentions were not to defraud the government instead it was you Rich. That is why you didnt send out any w-2's because you didnt think you would be caught. Your wrong about the money I hired on as your employee because I wanted to help homeowners stay in there homes and not lose them. Instead I kept believing all of your excuses until December 02, 2008 I left because I was not going to be a part of your home scamming sceam any longer. I took action and left. Im going to keep this is as brief as possible because lets face it, my time is much better spent helping my clients and singing the itsy bitsy spider with my little one year old. That being said, I simply cannot allow such unfounded allegations to be left uncontested as I fear my silence may be misinterpreted as guilt and I simply cant allow that to happen. First off: April kept very poor records and bailed on us at the last minute leaving several files unattended (many of which were clients she referred). She couldnt handle the stress and left the company before we had a chance to find a replacement; jeopardizing the homes of dozens of people. Anyone with a conscience would feel badly about that. She pulled the pin and left us holding the grenade in a room full of people. To date she has not taken any responsibility for her actions (or inaction's for that matter) and how they affected the lives of the clients whose files she was responsible for processing. She'd rather put the blame on our company as if she had absolutely no hand in what transpired in the several months she was employed with us. How can she blame Samaritan Financial for not properly servicing its clients when SHE was the one hired and assigned to do just that and failed? She claims I was too busy to take her call sometimes, but failed to mention she was too incompetent to do the job independantly. Apparently it was I who was scammed by a woman who lead me to believe my clients files would be in good hands with a "seasoned professional". Secondly: Our forensic mortgage audit is simply an analysis of our clients mortgage which lists in detail all lending law violations (RESPA, TILA, etc) discovered in the final closing documents. To say it's illegal is ridiculous and untrue. Our audits, when enforced by an attorney can go a long way in forcing the lenders hand in negotiating a loan modification. Sometimes the QWR (qualified written request) when sent in conjunction with a mortgage audit is enough to sway the lender if they cant provide the promissory note we demand (which by the way is in accordance with RESPA statutes). Predatory lending is a real problem and is for the most part responsible for the housing crisis we are living through today. Our audits have helped many foreclosure defense attorneys stay foreclosure sales and leverage modifications for their clients. Third: Unlike the countless loan modification scams out there, we do not live on the internet, lurking in the shadows undetected. Our office is in plain view, located in the heart of Weston. We're on every Sunday at 1pm (and have been for the last year) offering advice on foreclosure prevention, predatory lending practices, the pitfalls of mortgage lending and general information on how to shop for a mortgage that meets our listeners needs. We encourage our listeners to contact their lender first, but end up getting calls from countless homeowners whose lenders wont return their calls let alone reduce their mortgage payments. She may have later discovered that her salary fell within the parameters of the disability income guidelines, but initially her intention was to defraud the government, no question about it. Thats a pretty bad way of putting it. Lets just say she was looking to bend the rules a bit and get away with a little extra money. Either way, whats done is done. No harm no foul when it comes to her and Social Security Im sure. I may not agree with how she handles herself professionally, but I believe she's a good person and a loving parent who ultimately just wants whats best for her daughter. Just to clarify to Mr. Rich Diaz I April Heckrodt was not the one who wrote the initial complaint against Samaritan Financial Solutions, Inc. it was my husband who wrote it. I didnt think that you would stoop to that level Rich by stating false allegations about myself. To set the record straight with you Rich Diaz I have been in contact with both the social security office and the internal revenue service since last year. I did not defraud them and they stated to me that I did nothing wrong because my earnings that I got paid from you was less than the allowable earnings. I only got paid in July 2008 500.00, August 2008 500.00 , September 2008 800.00, October 2008 800.00, and November 2008 you shorted me 400.00 and only paid 400.00 to me in February 2009 instead of in 2008 when it was due and is when I worked for you. I have reported this information both with the social security office and the IRS which the IRS sent me the 4852 form to file being that you neglected to send me my W-2 form by January 30, 2008 by law. You Rich Diaz are in violation for not sending me my W-2 form. I am greatly disappointed with you Rich as you did not state facts as ""I left Samaritan Financial Solutions, Inc. because you Mr. Rich Diaz was not getting the information that customers lenders needed in timely fashion instead you would always have an excuse by saying you were busy instead of stating the real truth that instead of getting the customers loans modified you put them into foreclosure including my own personal home. What my husband stated about your company was all facts and if you cant handle the facts maybe your in the wrong business. I did my job when I worked for you Rich it was you that was not if you go back through all of the paper files of notes and documentation that I did myself and the emails with documentation you will find out the real truth lies within yourself not me. I hope you still have all the emails and paper documents that I sent to you and received confirmation from you that you received it as those documents you have to hang on to for at least 10 years and are not allowed to destroy them before then. I did nothing wrong against you Rich Diaz I left your company because I was not going to sit back and see all the clients homes being taken away instead I left because of what you were doing to the customers and because you were causing me health problems that I didnt need being that I am already disabled. I am greatly disappointed that you didnt stand behind your 100% money back agreement you only refunded me 200.00 back of the 1700.00 due. I really hope that no one else gets scammed as we did by you. I have numerous emails Rich where you said you were going to do or send something pertaining to my loan modification and was not done. The mortgage audit was not legal as what you had in it was not all true and you had it messed up 6 times it took you to get it corrected without errors of other customers names. This was unacceptable. I hope the IRS, Social Security and anyone else pays close attention to the above and does not get Scammed by Samaritan Financial Solutions, Inc. by taking your money and putting your home into foreclosure like they did ours and had to hire an attorney to get us out of the mess. We were not behind in our mortgage when we went with Samaritan Financial Solutions, Inc. as per Mr. Rich Diaz stated for us not to make our mortgage payment instead save it as if we made it would make it difficult in getting a loan modification approved. To above referenced peron I highly recomend you contact the Attorney Generals office regarding this situation. If Mr Diaz took an upfront fee from you after OCt 1 then he is operating illegally. Mr Diaz was a past employee of mine. Im actually quite amazed about the disability comment since he only wante to be paid under the table IRS issues I guess. He worked for me briefly decided to steal my companies documents and proprietary information before he decided to attempt to get in the business by himself. These are not just allegations I have his companies documents and mine and the only thing different is the header. Ethical I say not, common in todays sea of ex subprime mortgage people I say yes. Unless you retained an attorney than he should of not taken upfront fees!

Samaritan Financial Solutions is an anti-predatory lending company that specializes in providing Forensic Mortgage Audits to homeowners who have been victimized by predatory lending. Our reports expose mortgage fraud and predatory lending practices enabling our clients to leverage a permanent loan modification of their loans when their lenders fail to comply otherwise. Over 90% of all subprime loans written over the last 5 years have an average of 30 Federal Lending law violations meaning homeowners may be due thousands of dollars in penalty fees and may unknowingly be in a position of power to force their lenders hand to reduce their interest rate, mortgage payment and in some cases their principal balance. April Heckrodt (the woman who wrote this report) was not only a client of Samaritan Financial. She was also an employee of ours who was hired as a Processor responsible for facilitating the initial process of contacting lenders and confirming our authorization to request signed loan documents from lenders on our clients behalf. It was also her responsibility to make sure all of the files assigned to her (40) were updated and complete. She was paid for her time and effort until it we discovered two very alarming facts: 1. April Heckrodt was not properly servicing our clients and failed to meet some very crucial deadlines as it pertained to our clients mortgage accounts and pending foreclosures. 2. She was intentionally defrauding the Federal Government by working for us full time while receiving disability benefits. This was learned after she asked that we pay her husband instead of her in effort to hide her earnings from the Federal Government. She was knowingly earning in excess of the social security administrations earnings limit and did not want to risk permanent income loss. When confronted about her disability and poor performance, April Heckrodt abruptly left the company out of fear that she would be exposed and would lose her disability benefits as a result. Her sudden departure from the company left over three dozen files undone putting our clients at risk of foreclosure, significantly increasing our workload and potentially costing our company thousands of dollars. Since she left the company, we have found a very competent replacement who has been doing a great job of providing our clients with the quality service they deserve. As with every one of our clients, Samaritan Financial fully disclosed its services and fees to April Heckrodt in the consulting agreement she signed and notarized. Her lender was contacted and a thorough forensic mortgage audit was completed on her file and was provided to her, which she approved, signed and submitted to her lender. Over 25 violations were found in her loan documents, to include but not limited to inflated income and fraud (a fictitious account with $100k was listed in the asset section of her application). Could it be that our audit was a bit too thorough and in actuality it was her that falsified information on her loan application? Our written agreement with April Heckrodt did not include a Forensic Mortgage Audit (a service we were willing to offer free of charge to her when she was hired). Since she terminated the agreement we refunded her money less 50% of the fee we charge for the forensic mortgage audit saving her more money than she invested initially. Being a former employee of a lender, April knew exactly what she was paying for and thoroughly understood the consulting agreement she and her husband Jeff signed. Samaritan Financial has helped countless homeowners negotiate a permanent reduction in their mortgage payment and can provide proof of such modifications. April clearly could not handle the job and was only looking for an opportunity to earn some extra money to add to the financial benefits she was already receiving from social security. Campaigning against a company that employed her, helped her and refunded her money is wrong and is terribly disappointing. Samaritan Financial would be delighted to provide proof of some of the loans we have successfully modified along with an example of one of our forensic mortgage audits to anyone who requests it.
