Once you provide evidence that they have been collecting on your property illegally you can take it to court and petition to void the deed of trust.

All Lenders are must produce the Documents required by Law to prove ownership of the loan. This is called Validation.

But I must tell you the final (I hope) chapter. After closing my new loan, I received paperwork from Saxon showing what my refund would be (990.++ escrow account refunded to me) it, of course, was inaccurate. I called and explained they were charging me interest for July 1 through Sept 6 when July payment had already been paid and the loan would have closed in October had it not been for their attorney not filing the paperwork in January to dismiss the foreclosure that never happened. (the paperwork was not filed until I called and raised sand in July.) While my current mortgage lender was trying to get the attorney to file the paperwork, they were told the foreclosure was dismissed in bankruptcy proceedings, it took us two weeks to convince them I NEVER had a bankruptcy! Anyway, Saxon had their stock reply, "we'll investigate" three weeks later I received a check from Saxon for over 2000.00, no break down, nothing. I figure it was the corrected escrow amount (which was over 1000.00 to begin with) plus all the inaccurately charged fees I had raised so much cain about! A week later I got another check for about 40.00 again no explaination. But Saxon did get their last dig in, any time I've paid off a mortgage in the past the paid off mortgagor filed all necessary paperwork to release the lein. Last week I got a letter from Saxon with the release of Lein attached saying "I" needed to file it at the courthouse. So now I have to go pay the filing fee. Of course the previously mentioned credit report errors have never been corrected as a matter of fact, they verified, the inaccurate information recently! But I'm done with them and couldn't be happier, I see the attorney next week to see what I can do to stop them from doing his to others and I do plan on having him look at this site to see I am not the only one they have done this too! Keep tryng to get away from Saxon if you can, trust me, you can even with crappy credit (like I have) first obtain and scrutinize your credit report, dispute anything you can (double reported items, incorrect info, expired accounts, refinanced accounts where oldand new account is showing) the more you have deleted the better you score will be. It took me three months to get my credit barely over 500 by having items removed, some I had to dispute two or three times. Get your score to at least 500 and you can get refinanced with someone else. Your rate may not be attractive and your payment may even be a little higher but you'll be rid of the Saxon monkey and in 6 months to a year, if you keep the account current, you can refi for a better rate! Keep up the good fight and good luck!!!!
